Das Forschungsprojekt "Von der Flüchtlingshilfe zur Fluchthilfe" geht aus von der Problematik des Asylparadoxes und dem Umgang zivilgesellschaftlicher Akteure mit seinen Konsequenzen: Zwar gelten in Deutschland das Grundrecht auf Asyl und die völkerrechtlichen Prinzipien des Flüchtlingsschutzes und viele Staaten gewährleisten Flüchtlingsrechte. Um diese zu erlangen, müssen die meisten Schutzsuchenden allerdings mangels legaler Einreisemöglichkeiten illegal Grenzen überqueren und sich in riskante Situationen begeben. Insbesondere durch die sich in den Jahren 2015 und 2016 zuspitzende Lage entwickeln sich in Deutschland vermehrt gesellschaftliche Auseinandersetzungen um den Zugang zu Flüchtlingsschutz. Das Forschungsprojekt analysiert diese Auseinandersetzungen mit Fokus auf das Engagement zivilgesellschaftlicher Initiativen für die sichere Einreise von Flüchtenden. Daher geht das Projekt der Forschungsfrage nach, welche Handlungsansätze und Strategien zivilgesellschaftliche Initiativen im Kontext von Migrations- und Fluchtregimen entwickeln, um sich angesichts beschränkter Einreisewege und humanitärer Notlagen für einen Zugang zum Schutz für Geflüchtete einzusetzen und Fluchthilfe zu leisten.

In our part of the project (Work package 6) will investigate the responses given to migration at different scales. It aims to provide an in-depth understanding of responses provided by actors ranging from urban to rural contexts, from transnational city-city collaborations to local community initiatives. Local scale is one of the first spaces where migration needs to be governed. Cities different than governments include networks of public and private sector leaders and institutions that include citizen initiatives, trade unions, private companies and universities, among others. A multi-scalar approach will be implemented by examining three different types of cases (1) The case of urban-rural development in Sweden, via international migration, (2) The case of local migration ecosystems in Northern Italy, (3) The case of Greek islands in the Aegean Sea, (4) The case of transnational collaborations and social innovations. By engaging in multi-scalar case studies, the aim is to cover both official and unofficial responses to the so called “refugee crisis”, emphasizing the role of the local authorities in facilitating (or hindering) the application of national policies on reception, redistribution and inclusion/exclusion of newcomers as well as the increasing role of communities and innovations in shaping the migration response by also showing opportunities. These areas, with the potential benefits of interdisciplinary research, will seek synergies between the following two goals; SDG Goal 9 on building resilient infrastructure as well as Goal 11 on inclusive cities. By doing so, we will inform policy making in these areas and potentially contribute to the implementation of the UN Sustainable Development Goals.

National legislation complies with universally recognised norms of the international law, in particular: the definition of the ?refugee? notion, grounds for granting refugee status and subsidiary protection comply with similar provisions of international legal documents (in particular, the 1951 UN Convention ?Relating to the Status of Refugees?). Belarus ratified international treaties on economic, social and cultural, civil and political rights and joined the International Convention on the Elimination of All Forms of Racial Discrimination and Convention for the Suppression of the Traffic in Persons and of the Exploitation of the Prostitution of Others. Foreign citizens applying for recognition as refugees as well as recognised refugees enjoy special privileges and may count on certain types of aid on behalf of the state. In particular, according to the national legislation in Belarus, socio-economic rights of refugees are equal to the rights of citizens of the Republic of Belarus, refugees are granted free access to the national system of education and health system. Children of refugees enjoy the right to attend preschool facilities. Currently the drawback of the national legislative system in the discussed area is underregulation of issues related to refugee integration, conditions for their active participation in the life of society, ensuring equal rights and opportunities for men and women. Besides, representation of legal provisions in a multitude of statutory acts, including by-laws and decisions of state agencies, makes their application inconvenient. It also has a negative effect on the quality of cooperation and coordination of work of public authorities when addressing issues related to granting asylum.

Le présent rapport fait la synthèse des principaux débats et des évolutions majeures concernant les migrations et l’asile au Luxembourg en 2017. Le nombre de personnes demandant une protection internationale est resté élevé en 2017 (2 322 demandes) par rapport aux niveaux enregistrés avant la « crise migratoire » (1 091 en 2014). Toutefois, ce nombre est resté relativement stable par rapport aux deux années précédentes (2 447 en 2015 et 2 035 en 2016). Cette stabilité relative s’est également reflétée dans le débat public et politique dans le domaine des migrations et de l’asile. Depuis 2016, l’accent n’a cessé de se déplacer d’un discours « d’urgence » axé sur la mise en œuvre de mesures et de conditions d’accueil vers des discussions sur des mesures et des politiques d’intégration à plus long terme. À cet égard, le nouveau parcours d’intégration accompagné (PIA) peut être considéré comme un projet phare de l’OLAI, l’Office luxembourgeois de l’accueil et de l’intégration des étrangers. Le PIA vise à autonomiser les demandeurs et les bénéficiaires d’une protection internationale et à les soutenir dans le développement de leur projet de vie. Le parcours, obligatoire pour tous les demandeurs adultes de protection internationale, se compose d’une composante linguistique et d’une composante civique, et il est divisé en trois phases. Bien que l’augmentation des capacités d’hébergement des demandeurs de protection internationale (DPI) figure parmi les priorités des autorités nationales, le logement des DPI reste très problématique et a déclenché un débat à l’échelle nationale. Outre l’accès à la formation, les problèmes liés au logement des DPI ont été parmi les questions les plus fréquemment soulevées en 2017. La pression sur le logement des DPI et des bénéficiaires de protection internationale (BPI) est importante : le manque de logements abordables sur le marché privé, le nombre croissant de réunifications familiales et la progression du nombre de BPI et de personnes qui ont fait l’objet d’une décision de retour mais qui restent hébergées dans les structures de l’OLAI ont été identifiés comme facteurs de pression. Les difficultés liées à la construction de structures modulaires d’hébergement ont également persisté en 2017. Une certaine réticence de la population à l’égard de la construction de ces « villages conteneurs », prévue en réponse à l’afflux croissant qui a commencé en août 2015, était visible dans les recours introduits devant les tribunaux administratifs pour annuler les plans d’occupation des sols liés aux projets. Les conditions de vie au sein des structures d’accueil ont également fait l’objet de discussions. Elles portaient notamment sur l’absence d’équipement en cuisines de plusieurs lieux d’accueil, les différents systèmes d’approvisionnement en nourriture et les types de nourriture disponibles. Afin de répondre au nombre toujours important de DPI en provenance des pays des Balkans occidentaux, une procédure ultra-accélérée a été mise en place. Cette procédure a été instaurée pour diminuer les pressions sur les structures d’accueil et pour éviter de créer de faux espoirs pour les séjours de longue durée. En avril 2017, la structure d’hébergement d’urgence au Kirchberg (SHUK) a été mise en place, afin d’héberger les DPI pour lesquels le Luxembourg n’est pas compétent pour examiner les demandes en vertu de l’application du règlement de Dublin. Ce nombre a fortement progressé. Le placement à la SHUK correspond à une assignation à résidence, donc à une alternative à la rétention. La structure nouvellement créée ainsi que les conditions d’affectation ont néanmoins été critiquées par la société civile. Plusieurs acteurs de la société civile ont manifesté leur opposition face à une disposition de la loi du 8 mars 2017 qui a étendu la période de rétention des adultes ou familles avec enfants de 72 heures à 7 jours afin de rendre plus efficiente l’organisation du retour. Un premier bilan du fonctionnement du Centre de rétention a été publié en 2017. Une commission chargée d’évaluer l’intérêt des mineurs non accompagnés dans le cadre d’une décision de retour a été créé fin 2017. La commission est chargée de mener à bien des évaluations individuelles concernant l’intérêt supérieur de l’enfant dans le but de prendre une décision de retour ou d’accorder une autorisation de séjour. Parmi les éléments pris en considération lors de cette évaluation et dans le contexte d’une éventuelle décision de retour figurent également les informations fournies par l’Organisation internationale pour les migrations (OIM). Cette dernière a conclu un accord avec la Direction de l’immigration pour rechercher les parents de mineurs non accompagnés dans le pays d’origine. Comme les débats s’orientent lentement vers l’intégration à long terme, le Conseil de gouvernement a également approuvé l’élaboration d’un nouveau plan d’action national sur l’intégration. Le plan sera basé sur deux axes : l’accueil et le suivi des demandeurs de protection internationale et l’intégration des résidents non luxembourgeois au Luxembourg. L’Agence pour le Développement de l’Emploi (ADEM) a créé une cellule BPI au sein de son Service employeurs. Cette cellule fournit aux employeurs des renseignements sur les demandes d’emploi et les évaluations des compétences des BPI. Une nouvelle loi sur la nationalité luxembourgeoise est entrée en vigueur le 1er avril 2017. Cette loi s’inscrit dans le contexte démographique particulier du Luxembourg, caractérisé par une augmentation continue de la population totale avec, en parallèle, une diminution de la part des Luxembourgeois dans la population totale. A travers cette loi, le législateur veut favoriser l’intégration sociétale et politique des citoyens non luxembourgeois et renforcer la cohésion au sein de la communauté nationale. Les principaux changements introduits par la loi consistent en la réduction de la durée de résidence pour la naturalisation (de 7 à 5 ans), l’introduction du droit du sol de la première génération, la réinstauration de voies simplifiées d’acquisition de la nationalité luxembourgeoise par « option », ainsi que de nouveaux scénarios pour éviter les cas d’apatridie. La loi maintient les exigences linguistiques antérieures tout en procédant à quelques ajustements afin d’empêcher que les exigences linguistiques ne deviennent un obstacle insurmontable. En vue des élections communales du 8 octobre 2017, le ministère de la Famille, de l’Intégration et à la Grande Région a lancé une campagne d’information et de sensibilisation intitulée « Je peux voter » en janvier 2017. Cette campagne avait pour but d’inciter la population étrangère du Luxembourg à s’inscrire sur les listes électorales pour les élections communales. L’intention du Gouvernement de légiférer sur la dissimulation du visage était sans doute l’un des sujets les plus débattus dans le domaine lié à la vie au sein de la société au Luxembourg et l’intégration au sens large du terme, tant à la Chambre des députés que dans les médias et la sphère publique. Le projet de loi n° 7179 vise à modifier l’article 563 du Code pénal et à créer l’interdiction de dissimuler le visage dans certains espaces publics. Il définit la dissimulation du visage comme le fait de couvrir une partie ou la totalité du visage de façon à rendre l’identification de la personne impossible. Des vues opposées entre les parties prenantes – les partis politiques, les institutions publiques, la société civile ou les médias – se sont exprimées au sujet de la nécessité de légiférer en la matière et dans l’affirmative, sur les motifs et l’étendue de l’interdiction de la dissimulation du visage. Le phénomène des migrations a eu aussi comme conséquence de renforcer l’hétérogénéité de la population scolaire. Pour faire face à cette situation, les autorités scolaires ont continué à diversifier l’offre en matière d’éducation et de formation. Parmi les mesures mises en place, on peut signaler notamment l’élargissement des offres de cours d’alphabétisation et de formation de base, l’extension de l’offre au niveau des écoles internationales et européennes et la mise en place d’un programme d’éducation plurilingue au niveau de la petite enfance. Dans le domaine de l’immigration, les changements les plus importants concernent la politique d’admission de certaines catégories de ressortissants de pays tiers. À cet égard, le projet de loi n° 7188 vise principalement à transposer la Directive européenne 2016/801 du Parlement européen et du Conseil du 11 mai 2016 sur les conditions d’entrée et de séjour des ressortissants de pays tiers à des fins de recherche, d’études, de formation, de volontariat, de programmes d’échanges d’élèves ou de projets éducatifs et de travail au pair. La directive vise à faire de l’Union européenne un centre mondial d’excellence en matière d’études et de formation, tout en favorisant les contacts entre les personnes et leur mobilité, deux éléments importants de la politique extérieure de l’Union européenne. Le projet de loi vise à faciliter et à simplifier les procédures de mobilité intraeuropéenne des chercheurs et des étudiants qui sont des ressortissants de pays tiers. De plus, certaines modifications comprennent des mécanismes incitatifs pour retenir les étudiants et les chercheurs. À cette fin, il propose que les étudiants et les chercheurs, une fois leurs études ou recherches terminées, puissent se voir délivrer un titre de séjour pour « raisons privées » pour une durée maximum de 9 mois en vue de trouver un emploi ou de créer une entreprise. Enfin, le projet de loi entend réglementer le regroupement familial d’un chercheur séjournant au Luxembourg dans le cadre d’une mobilité à court et à long terme. Le législateur a par ailleurs transposé la Directive 2014/36 sur les travailleurs saisonniers et la Directive 2014/66 sur le transfert temporaire intragroupe en droit national, et a adapté le dispositif de l’immigration aux besoins de l’économie en introduisant entre autres, une autorisation de séjour pour les investisseurs. L’organisation de l’admission du séjour et de la délivrance des autorisations de séjour était également un élément clé de l’Accord entre le Luxembourg et le Cap-Vert relatif à la gestion concertée des flux migratoires et au développement solidaire. L’accord approuvé par la loi du 20 juillet 2017 poursuit en outre les objectifs suivant : promouvoir la mobilité des personnes, lutter contre l’immigration irrégulière, préciser les procédures de réadmission, renforcer l’intégration légale des ressortissants concernés, ainsi que mobiliser les compétences et les ressources des migrants en faveur d’un développement solidaire.

La mobilité globale fait aujourd’hui partie de la texture sociale de la mondialisation et des relations internationales. Elle est à la fois une cause et une conséquence de la mondialisation et les réponses des institutions politiques nationales et internationales sont un enjeu clef de l’analyse de la gouvernance et des transformations sociales à l’échelle globale. Elle est un des points de tension de la modernité politique à l’échelle nationale et internationale. En s’intéressant tout à la fois aux organisations internationales, aux politiques migratoires nationales et régionales des Etats, aux modes d’organisation des espaces de vie des migrants et des réfugiés et aux dynamiques sociales transnationales de structuration de la mobilité, on observe le phénomène migratoire sous plusieurs angles et à différentes échelles. Les chercheurs impliqués dans ce projet ont choisi de privilégier une démarche empirique associée à un effort de systématisation qui emprunte à la science politique, à la sociologie, à l’anthropologie et à l’économie politique. Ils ont aussi choisi de lier leurs objets de recherche fondamentale à des enjeux politiques et sociaux immédiatement contemporains et à s’ancrer dans une réflexion scientifique sur l’action publique nationale et internationale, ses normes et ses principes vis-à-vis de la mobilité. Ce projet a pour vocation de donner une description précise de la mobilité et de ses dynamiques politiques et sociales, notamment en s’intéressant à l’observation empirique des pratiques des acteurs de la gouvernance de la mobilité (Etats, organisations internationales, migrants, réfugiés, réseaux). Il a pour objet d’élucider les représentations à l’œuvre dans ces pratiques, les dispositifs normatifs, idéologiques et identitaires qui les structurent. Le premier axe de ce travail concerne les pratiques et les représentations de la gestion de la mobilité en politique internationale. Il a pour enjeu la mise en questionnement de la notion de gouvernance globale de la mobilité, incluant migrations économiques et flux de refugiés. Les organisations internationales, leur interaction avec les acteurs non gouvernementaux de la politique des migrations internationales et des flux de réfugiés sont au cœur d’un dispositif politique qui est à la fois fait de discours et de pratiques. Le deuxième axe de ce projet observe les enjeux politiques de la gouvernance régionale des migrations dans deux espaces différenciés mais fortement marqué par leur contexte régional, l’Europe et le Moyen Orient. Il s’agit de déterminer la place de l’Etat dans la gouvernance de la mobilité à l’échelle régionale notamment dans le cas européen entre la fin du vingtième et le début du vingt-et-unième siècle. La « gouvernance » oscille entre intégration et « retour de l’Etat » dans la gestion des migrations internationales notamment avec la crise économique et financière, et on étudie les manifestations de cette « réaction souverainiste » sur la mobilité des personnes. Le troisième axe de ce projet s’attache à l’étude ethnographique des lieux de vie des réfugiés, les camps en ‘intéressant aux transformations sociales à l’œuvre dans ce espaces sociaux transnationaux institutionnalisés. Il s’intéresse notamment aux modes de gouvernance mise en œuvre par les acteurs humanitaires dans des contextes de conflits ou de crise et à l’autonomie (agency) des populations concernées et analyse celle-ci à travers la structuration et la matérialité des espaces de relégation et/ou confinement des réfugiés à l’échelle globale. Le quatrième axe de ce projet présente un dispositif prospectif qui vise à décrire les dispositifs contemporains les plus visibles de limitation de la mobilité –les murs et explorer des scenarii politiques d’ouverture des frontières et de libéralisation de la mobilité. Il constitue un complément et un prolongement théorique de l’ensemble des connaissances et analyses déployées dans le cadre de ce projet.

Der erhöhte Zustrom Geflüchteter und anderer Migrantinnen und Migranten nach Europa in 2015 hat zu erneuten Bemühungen für eine gemeinsame EU-Afrika-Agenda geführt, die sich mit Herausforderungen der Migration befasst. Zahlreiche Treffen, Veranstaltungen und Gipfel wurden (zumindest teilweise) diesem Zweck gewidmet, wie beispielsweise der Valetta-Gipfel in 2015, der G20-Gipfel in Hamburg 2017 und der EU-Afrika-Gipfel in Abidjan in November 2017. Viele bilaterale, regionale und kontinentale Afro-Europäische Rahmenregelungen und Richtlinien gingen diesen politischen Versammlungen voraus und mit ihnen einher. Dennoch funktioniert die aktuelle Herangehensweise – auch durch die EU-Partnerschaftsabkommen – nicht. Der 2018 MEDAM Assessment Report argumentiert, dass die EU-Länder stärker mit afrikanischen Staaten kooperieren sollten. Die Regierungen dieser Staaten werden eher bereit sein, ihre Staatsbürgerinnen und Staatsbürger nach einem abgelehnten Asylantrag in der EU zurückzunehmen, wenn legale Arbeitsmigration eine realistische Alternative darstellt. Eine aktive Auseinandersetzung zwischen afrikanischen und europäischen Ländern fehlt jedoch weiterhin. Kritikerinnen und Kritiker beanstanden einerseits die Tendenz, dass die Migrationszusammenarbeit europäische Interessen in den Vordergrund stellt, die Inkohärenz in der EU-Politikgestaltung und die ausgrenzende Art vieler Gipfel und Veranstaltungen. Andererseits werden afrikanische Regierungen für fehlendes Engagement in der Migrationsgovernance kritisiert. Ein wesentliches Problem ist, wie wenig bezüglich der Interessen, Beteiligung und Akteure bekannt ist, wenn es um die Steuerung von Migration geht – einschließlich Auswanderung (reguläre und irreguläre), Einwanderung und den Umgang mit vertriebenen Menschen. Das Projekt „Die Politische Ökonomie der Westafrikanischen Migrationsgovernance“ will die politischen Dimensionen von Migrationsgovernance und die zahlreichen Akteure (einschließlich zivilgesellschaftliche und subnationale) beleuchten. Dazu untersucht das Projekt wie die Instrumente und Institutionen zur Migrationssteuerung erstellt und implementiert werden, welche Interessen und Akteure einbezogen oder ausgeschlossen sind und welcher gesellschaftlichen Diskurs diese Interessen umgibt. Die qualitative Studie konzentriert sich auf vier Fallstudien – Gambia, Niger, Nigeria und Senegal – und basiert auf Feldforschung, einschließlich halbstrukturierter Interviews in den betreffenden Ländern. Das Projekt ist von Anfang an partizipativ und somit wird eine Veranstaltungsreihe stattfinden, um unsere Ergebnisse mit lokalen Experten in Abuja, Banjul, Dakar und Niamey zu diskutieren. Darüber hinaus wird es einen Abschlussworkshop geben, um die Forschungsergebnisse mit Wissenschaftlern und zivilgesellschaftlichen Akteuren aus allen vier WAMIG-Ländern vergleichend zu diskutieren. Das Projekt „Die Politische Ökonomie von Westafrikanischer Migrationsgovernance“ wird durch die Stiftung Mercator finanziert und im Rahmen des Mercator Dialogue on Asylum and Migration (MEDAM) durchgeführt. MEDAM ist ein dreijähriges Forschungs- und Beratungsprojekt, das Herausforderungen identifiziert und Handlungsstrategien zur Asyl- und Migrationspolitik der EU und ihrer Mitgliedsstaaten erarbeitet.

The research in this project critically analyses the on-going configuration of global and regional migration regimes within the framework of multilevel global governance. The main objective is to survey international institutional arrangements for core labor standards and migrant workers? rights and to explore their significance for migration management within the 'asymmetric' global governance, as well as their impact on the current trajectory of global and regional political economies. Various studies within the project trace the development of a 'social dimension' of globalization and the articulation of an inclusive, human rights-based policy approach to migration management. The focus is on the ILO?s reformulation of social justice goals in terms of 'decent work' for all workers, including especially those working in the informal economy. The identification of the main multinational, state and non-state actors, their discourses and strategies for the promotion of global social justice, in particular the role of the EU is examined. Since 2010 participants in this project have followed and analysed the UN High Level Dialogue on Migration, related Global Forum on Migration and Development (GFMD) and the role of global civil society actors in this process, leading to MIGLINK, a collaborative research project with Ankara University (Turkey) and University of Zacatecas Mexico).

The resolution of problems for asylum seekers, refugees, and IDPs encounters resistance, due to the cautious attitude of Federal government authorities, state governments, local governments, and the host population. The prevalence of a xenophobic attitude, pressure of non-governmental organizations that work with asylum seekers, and the weakness of civil society institutions create a distorted picture of the unimportance of this contingent’s problems, and weakens the potential readiness of the government and society for emergency situations related to the flow of asylum-seekers

Amid rising numbers of asylum seekers arriving in the EU and migrating along the Balkan route in 2015, state, EU and traditional NGO institutions failed to adequately receive, register and care for the new arrivals. Instead, volunteers stepped in to provide humanitarian assistance. They are locals as well as citizens from other European countries who engage with the crisis for a variety of reasons, in a range of contexts and with varying consequences. This research project will examine personal motives, social structures and political conditions of volunteering for refugees in countries along the so-called Balkan route: in Greece, in Slovenia, and in former Yugoslav countries. Based on political process tracing, sociological-ethnographic observations and semi-structured interviews with volunteers, officials, locals and refugees we will devise country reports that will create the basis for a comparative study. Thus, we will interrogate whether we can witness in this refugee policies ’from below’ the creation of a particular, pro-immigration and human rights based European civil society or social movement.

"Projektbeschreibung 2015 reisten mehr als eine Million Schutzsuchende nach Deutschland ein. Eine so große Zahl an Neuankömmlingen in einer so kurzen Zeit stellt das Land vor neue Herausforderungen.Deshalb besteht die dringende Notwendigkeit mehr über Asylsuchende, ihre Situation und Lebensumstände zu erfahren. Das Forschungsprojekt hat daher zwei Ziele: 1. Die Vielfalt der Bedürfnisse und Zukunftsvisionen von Geflüchteten soll untersucht werden. Dabei spielen die Wohnsituation, das Familienleben, der Zugang zu (Aus-)Bildung und dem Arbeitsmarkt sowie der Aufenthaltsstatus eine entscheidende Rolle. 2. Das Projekt betrachtet des Weiteren, wie staatliche und nicht-staatliche Akteure auf die Vielfalt der Fluchtbewegungen reagieren, z.B. wie logistische Herausforderungen angegangen werden. Der Zweck der Forschung? Die Ergebnisse sollen einen Beitrag zum besseren Verständnis der Vielfalt der derzeit Zugewanderten und der Strukturen, mit denen sie konfrontiert werden, leisten. Des Weiteren soll das Projekt dazu beitragen, die Grundlagen für langfristige Partizipation der Geflüchteten an gesellschaftlichen Prozessen zu verstehen. Wer wir sind Das Forschungsteam arbeitet am Max-Planck-Institut zur Erforschung multireligiöser und multiethnischer Gesellschaften in Göttingen und setzt sich aus vier Wissenschaftlerinnen und mehreren Assistenten zusammen. „Gäbe es die Zivilgesellschaft nicht, wäre das gesamte Asylsystem mittlerweile zusammengebrochen“ (I 17, Führungskraft, Nov.15). Die Flüchtlingskrise hat gezeigt, dass die Zivilgesellschaft eine wichtige Rolle bei der Bewältigung von Herausforderungen der Immigration und Integration spielt. Im Herbst und Winter 2015 wäre es ohne zivilgesellschaftliches Engagement in Österreich zu einer humanitären Katastrophe gekommen. Die Zivilgesellschaft hat in dieser Zeit besonders hohe Beiträge geleistet, sei es in der Erstversorgung, in der Organisation von Flüchtlingsunterkünften, in Integrationsmaßnahmen und in der Mobilisierung und Koordination freiwilliger Hilfe. Zudem haben zivilgesellschaftliche AkteurInnen auch die öffentliche Meinung mitgeprägt und die Vernetzung von Freiwilligen befördert. Es ist davon auszugehen, dass Integration ohne weitere Beiträge der Zivilgesellschaft und ihrer Organisationen auch in Zukunft nicht möglich sein wird. In dem vorliegenden Projekt wurde daher folgenden Fragen nachgegangen:  Was hat die Zivilgesellschaft im Herbst 2015 zur Bewältigung der sogenannten Flüchtlingskrise geleistet und wie wurde dies erreicht?  Wie wurde die Arbeit der Zivilgesellschaft von syrischen Flüchtlingen wahrgenommen?  Was kann daraus für die Bewältigung weiterer Herausforderungen der Immigration und Integration gelernt werden? Alle genannten Probleme bzw. Lernchancen müssen vor dem Hintergrund der Ausnahmeund Krisensituation sowie der hohen Leistungen der Zivilgesellschaft betrachtet werden. Eine große Herausforderung für die Organisationen waren Informationsdefizite und sich laufend ändernde Rahmenbedingungen. Auch die gesellschaftliche Polarisierung, Rechtsunsicherheiten bzw. die Nichteinhaltung von Gesetzen durch politische Instanzen und Defizite der wohlfahrtsstaatlichen Aufgabenübernahme waren belastend. Zum Teil hat die Zivilgesellschaft Aufgaben des Staates übernommen. Wo im Auftrag der öffentlichen Hand gearbeitet wurde, gab es häufig mangelnde finanzielle Planungssicherheit und späte Zahlungen für geleistete Arbeit. Die Situation der AsylwerberInnen war aufgrund der mangelnden politischen Abstimmung bzw. Bereitschaft zusätzlich belastet. Das Spektrum der angebotenen Leistungen war extrem breit, neben der Erstversorgung und Akuthilfe umfasst es die Organisation von Wohnraum, Weiterbildungen oder Freizeitgestaltung, Kinderbetreuung, Übersetzungsarbeit, Rechtsberatung, Unterstützung bei Behördenwegen, gesundheitliche Versorgung und vieles mehr. Die Bereitschaft zu freiwilligem Engagement nahm im Herbst 2015 ein Hierzulande nie dagewesenes Ausmaß an. Freiwillige haben sich in nahezu allen Bereichen der Flüchtlingsarbeit engagiert. Viele Freiwillige wurden selbstorganisiert und spontan tätig, ein Großteil allerdings half im Rahmen bestehender NPOs oder neugegründeter Vereine. Für die zivilgesellschaftlichen Organisationen war die Mitarbeit dieser vielen Menschen absolut notwendig, um das hohe Leistungsniveau anzubieten. Mit viel Einsatz und Empathie wurde nicht nur ein hohes Maß an Hilfe geleistet, sondern damit auch ein politisches Statement für Menschlichkeit und Toleranz gesetzt. Das Management der vielen HelferInnen war unter den gegebenen dynamischen Rahmenbedingungen allerdings auch eine Herausforderung. So war eine vorausschauende Bedarfsplanung aufgrund externer Faktoren, wie der Öffnung bzw. Schließung von Grenzen oder der Bereitstellung von Unterkünften und Transportmöglichkeiten kaum möglich. Insgesamt betrachtet haben es die NPOs geschafft, sehr flexibel auf Anforderungen zu reagieren. 2 Die Mobilisierung und Gewinnung von HelferInnen hat über alle Organisationen hinweg größtenteils gut, schnell und unbürokratisch funktioniert, u.a. mittels intensiver und effektiver Nutzung von Social-Media. So konnten die Leistungen der Freiwilligen trotz eines Rückgangs der Engagementbereitschaft im Laufe des Winters aufrecht erhalten bleiben. Aufgrund des hohen und schwer planbaren Bedarfs wurden breite, unspezifische Maßnahmen zur Gewinnung von Freiwilligen gesetzt. Dadurch konnten ausreichend HelferInnen mobilisiert werden, vielfach kam es aber auch zu einem temporären Überangebot an Freiwilligen. In der akuten Phase gab es oft nur eingeschränkte Möglichkeiten zur Selektion von Freiwilligen, es waren kaum Auswahlverfahren möglich und auch die Möglichkeiten zur Orientierung und Einschulung der HelferInnen waren begrenzt und es kam mitunter zu einem Mis-match zwischen Tätigkeiten und Ansprüchen der HelferInnen. Zu Beginn der Akutphase im September fehlten oft klare Kompetenzaufteilungen zwischen Haupt- und Ehrenamtlichen. Andererseits entstanden daraus große Spielräume für die Freiwilligen, die sich vielfach selbst organisierten, Strukturen aufbauten und sich in einem Mix aus Erfahrenem und Neuem selbst einschulten, koordinierten und in ihrer Arbeit ergänzten. Häufig waren diese Spielräume auch der Ausgangspunkt für die Gründung neuer Initiativen. Die Übertragung von Verantwortung an die Freiwilligen hat v.a. dann gut funktioniert, wenn Organisationen klare Ziele und Ansprechpersonen definierten. Weiters wichtig waren Information, Feedback-Kanäle und die Einbindung der Freiwilligen in die Gestaltung der Tätigkeit. War dies nicht gegeben, kam es zu Überforderung, Frustrationen oder auch Konflikten mit bestehenden oder neu eingeführten Ablauf- und Entscheidungsstrukturen. Eine weitere Herausforderung stellte die hohe Fluktuation sowohl unter Freiwilligen als auch z.T. unter den hauptamtlichen KoordinatorInnen dar. Diese erschwerte die Etablierung von strukturierten Kommunikationskanälen und die Informationsweitergabe und führte zu Ineffizienzen in der Ablauforganisation und Ärger bei manchen Freiwilligen. Dies betraf eher etablierte NPOs. Basisinitiativen, die ihre Strukturen um aktuelle Ziele formten, konnten teilweise sehr rasch funktionale Kommunikationskanäle aufbauen. Sowohl Freiwillige als auch Hauptamtliche waren oft mit enormen Belastungen konfrontiert. Maßnahmen gegen Überlastung und Supervisionsangebote und sonstige Formen der Unterstützung waren daher für alle MitarbeiterInnen wichtig. Sie wurden sehr geschätzt, und hätten früher und stärker angeboten werden können. Neben der Tätigkeit selbst trugen auch Anerkennung in (sozialen) Medien der Organisationen und in den Teams zur Motivation bei. Es gab große Unterschiede in der Struktur und Kultur der beteiligten Organisationen. Hier ist ein Kontinuum beobachtbar, entlang der Differenz Hierarchie/Struktur versus Flexibilität/Offenheit. Die eher hierarchisch organisierten Einsatzorganisationen konnten schnelle Entscheidungen treffen, rasch mit ähnlichen Organisationen kooperieren und sie konnten auf die für Katastrophenfälle vorbereiteten Strukturen zurückgreifen. Selbst etablierte Hilfsorganisationen mussten diese erst durch learning by doing aufbauen. Neu gegründete Basisinitiativen wiederum hatten den Vorteil von Flexibilität und Offenheit für spontane Entscheidungen. Für manche Freiwilligen waren diese Strukturen motivierend, andere fühlten sich in klareren Strukturen wohler. In fast allen Organisationen wurde aber von strukturellen Änderungen berichtet, so waren Einsatzorganisationen mit der Notwendigkeit flexiblerer Bereiche konfrontiert, Basisinitiativen machten häufig eine vergleichsweise rasche Entwicklung zu stärkeren Strukturen durch. Die Organisationen haben generell Herausforderungen des sehr raschen Größenwachstums und der Notwendigkeit organisationaler Flexibilität überraschend gut bewältigt. Es wurde Mehrarbeit bewältigt, rasch neues Personal eingestellt und eingesetzt, Regeln bewusst zeitweise außer Kraft gesetzt, aber gleichzeitig notwendige Strukturen bewahrt. Fast alle Organisationen berichten von deutlichen Lernschritten. 3 Kooperationen innerhalb der Zivilgesellschaft funktionierten grundsätzlich gut, in der Regel umso besser, je ähnlicher die PartnerInnen einander waren. Die Kooperationen zwischen strukturell unterschiedlichen AkteurInnen war zum Teil schwieriger, hier gab es unterschiedliche Standards in Bezug auf Verlässlichkeit, Reaktionsgeschwindigkeit, Spielraum für Einzelpersonen etc. Zur Kooperation mit der öffentlichen Hand gab es unterschiedliche Aussagen, z.T. wurde diese als erfolgreich beschrieben, z.T. aber auch kritisiert, v.a. die Nicht-Wahrnehmung von Aufgaben seitens der öffentlichen Hand betreffend. Die Einrichtung der Stelle eines Flüchtlingskoordinators durch die Stadt Wien wurde sehr positiv wahrgenommen, sie unterstützte die Bündelung des Hilfsangebots, v.a. durch die zentrale Informationsstelle. Wenngleich die Arbeit von vielen als sehr befriedigend wahrgenommen wurde, so war sie auch extrem belastend. Zum einen waren viele Hauptamtliche wie Freiwillige zu lange im „Notfallmodus“, sie arbeiteten am Limit. Es gab Freiwillige, die für den Einsatz ihren Job gekündigt oder ihr Studium aufgegeben hatten, Engagement im Ausmaß von 15h oder mehr pro Tag war keine Seltenheit. Auch seelische Belastungen wurden von fast allen wahrgenommen, deutlich mehr allerdings von Personen, die für diese Art von Tätigkeit nicht ausgebildet waren. Die befragten syrischen Flüchtlinge schätzen die vergleichsweise gute Behandlung in Österreich, die Leistungen der Zivilgesellschaft und die soziale Absicherung – sofern sie bereits in deren Genuss kommen. Gleichzeitig berichten alle von erheblichen Problemen, v.a. in Bezug auf lange und ungewisse Verfahren, die Situation und Versorgungslage in Notquartieren, Deutschkurse, Schwierigkeiten bei der Wohnungs- und Arbeitssuche nach Erhalt des Asylbescheides. Manche sind auch enttäuscht, da sie höhere Erwartungen an Österreich hatten, nicht zuletzt aufgrund falscher Versprechungen durch SchlepperInnen. Generell war das Anwachsen zivilgesellschaftlichen Engagements positiv für das Image der Zivilgesellschaft und der NPOs, für das Selbstbild und die persönliche Weiterentwicklung vieler Beteiligter, für Kontakte zwischen Einheimischen und Asylsuchenden und natürlich auch für die Aufrechterhaltung der Versorgung. Gesellschaftspolitisch ist es dennoch kritisch zu beurteilen, dass quantitative und qualitative Standards dem Wollen und Können privater AkteurInnen überlassen wurden. Verantwortungsbewusste Menschen haben somit auf eigene (zeitliche und materielle) Kosten die Lücke geschlossen, die der Staat gelassen hatte. Eine professionelle und mit Ressourcen abgesicherte Grundversorgung durch die öffentliche Hand und NPOs könnte Sicherheit stiften. Der Zivilgesellschaft bliebe Spielraum für Aufgaben der Integration, u.a. der Schaffung eines engmaschigen Netzes von direkten Kontakten zwischen den Zugewanderten und der lokalen Bevölkerung. Hier kann auch eine wichtige Rolle für größere NPOs liegen, nämlich die Unterstützung lokaler, basisorientierter Initiativen, die Integrationsarbeit leisten. „Im Moment (Anm. November 2015) habe ich das Gefühl, ganz Österreich ist Zivilgesellschaft. Der Staat hat sich ganz zurückgezogen, überzeichnet gesagt“ (I 17).

There is limited information on the number of forced migrants from Belarus. Key information can be found in the statistical publications of the United Nations Office of the High Commissioner for Refugees (UNHCR). Belarusian office of this organization gives the following explanation: “countries are guided by the principle of confidentiality of information submitted by an applicant. Public bodies of the asylum country have no right to transfer or provide any personal information about an application to his/her state of citizenship” (Delovaya Gazeta, 2013). According to UNHCR, the total number of persons from Belarus applying for refugee status, asylum or complementary protection was 6839 in 2011 and 6194 in 2012 (UNHCR, 2012; UNHCR, 2013). European countries (the Netherlands, Sweden, and Switzerland) and the USA were their countries of preference. Some estimates are available at the websites of Eurostat and US National Security Agency. According to the data for 1998-2007, 16255 citizens of Belarus sought asylum in EU member states (Eurostat Statistics). The main recipient countries were Germany, the United Kingdom, Sweden, France, the Czech Republic and Austria. The US National Security Agency also posts data on Belarusian refugees who arrived in the US territory. According to its estimates, there were 2844 of them 2003-2012 (Department of Homeland Security: 2012)

Turkey receives ever-increasing numbers of irregular migrants from its economically and politically unstable East and South trying to cross its territory towards Europe. Turkey has also experienced dramatic economic and social change. Therefore, with regard to international migration Turkey, once regarded as a sending country, has become a transit as well as a destination country. There are various categories of irregular migrants which may overlap. A smuggled, even a trafficked, migrant may seek asylum in Turkey. An asylum seeker may become an irregular employee. An irregular employee may apply for asylum. Similarly, someone who was heading for Europe through Turkey may get stuck in Turkey and be forced to start employment without a valid work permit. A rise in ‘irregular’ migration is an issue of concern in Turkey. Irregular migration has been perceived as having social, economic and security consequences. Restrictive legislation and reinforced control mechanisms have been introduced by Turkey over the years. International law and EU instruments are part of this legislation. 2003 was a milestone in coping with irregular migration since most of the legislation was adopted in that year and immediately afterwards. It should also be noted that despite Turkey’s restrictionist stance an intensification of global and regional disparities has brought about more irregular migration and, given the magnitude of the problem, the solutions are beyond the control of a single country, requiring international cooperation and coordination.

More than 51 million people worldwide are forcibly displaced today as refugees, asylum seekers, or internally displaced persons. According to the 1951 Geneva Convention Relating to the Status of Refugees, to be recognized legally as a refugee, an individual must be fleeing persecution on the basis of religion, race, political opinion, nationality, or membership in a particular social group, and must be outside the country of nationality. However, the contemporary drivers of displacement are complex and multilayered, making protection based on a strict definition of persecution increasingly problematic and challenging to implement. Many forced migrants now fall outside the recognized refugee and asylum apparatus. Much displacement today is driven by a combination of intrastate conflict, poor governance and political instability, environmental change, and resource scarcity. These conditions, while falling outside traditionally defined persecution, leave individuals highly vulnerable to danger and uncertain of the future, compelling them to leave their homes in search of greater security. In addition, the blurring of lines between voluntary and forced migration, as seen in mixed migration flows, together with the expansion of irregular migration, further complicates today's global displacement picture. This report details the increasing mismatch between the legal and normative frameworks that define the existing protection regime and the contemporary patterns of forced displacement. It analyzes contemporary drivers and emerging trends of population displacement, noting that the majority of forcibly displaced people – some 33.3 million – remain within their own countries, and that more than 50 percent of the displaced live in urban areas. The author then outlines and assesses key areas where the international protection system is under the most pressure, and finally examines the key implications of these trends for policymakers and the international community, outlining some possible policy directions for reform.

MIGLINK is a Swedish-Mexican-Turkish Research Links consortium specialised on migration and development. MIGLINK aims to examine the development of an incipient global governance framework for migration with a focus on the role of civil society. GFMD, initiated at the UN global dialogue High Level Dialogue on Migration and Development in 2006, is the most inclusive state-led forum between governments on developing policies for international migration. Since its inception, so-called "Civil Society Days" were organized as a side event to the GFMD meetings. The consortium follows preparation, agenda2012) setting, debates and outcomes of upcoming GFMD meetings among to contextualise them in historical and geographical perspective, aiming to identify the role of civil society in global policy making through the GFMD. This is matched by examination of the parallel development of a global movement of civil society in fora outside the formal framework of the GFMD and the formation of alternative agendas for global governance on migration. The consortium links interdisciplinary knowledge on the historical development of global governance on migration with a focus on conditions for sustainable development, poverty reduction, global labour and human rights. Dr. Stefan Rother, South Asian Studies at Freiburg University, with a long standing research trajectory in the subject area, joined the project in 2015.

Es wird kaum thematisiert, auch nicht in gegenwärtigen Debatten um die Einwanderungsgesellschaft, dass die Bundesrepublik Deutschland eines der wichtigsten Asylländer ist und schon immer Zwangsmigranten aus verschiedenen Gründen aufnahm. Sie bot Zuflucht für deutsche Vertriebene, für Asylsuchende, für umgesiedelte Flüchtlinge aus aller Welt und für solche, die vor Krieg oder aus anderer Not flohen. Zugleich war der Zugang zu Flüchtlingsschutz immer höchst selektiv. Die Begründungen aufgrund derer Zuflucht in der Bundesrepublik gewährt wurde, waren politisch umkämpft und verschoben sich von einem zivil-politischen zu einem kulturell-nationalen Modell und zurück. Dieses Forschungsprojekt untersucht die Geschichte der Zuflucht in der Bundesrepublik und die Veränderungen in politischen Debatten über Flüchtlinge. Sowohl das Thema als auch die angewendeten Konzepte sind dabei innovativ. Sie beziehen sich auf Modelle politischer Zugehörigkeit und Erinnerung, wodurch sie nicht nur die Geschichte und Theorie von Zuflucht sondern auch die politische Kultur des Aufnahmelandes in ein neues Licht rücken. Das Projekt basiert auf einem Konzept von Zuflucht als souveräner Zugehörigkeit für Ausländer. Das Privileg von Schutz wird gewährt auf Grundlage politisch umkämpfter Vorstellungen von Zugehörigkeit in zivilen oder kulturellen Begrifflichkeiten. Unter diesem Aspekt werden in dem Projekt politische Debatten zu sechs zentralen Momenten des Flüchtlingsschutzes in der Bundesrepublik genaustens, und manche erstmalig, untersucht: die Institutionalisierung politischen Asyls im Grundgesetz 1949; die Aufnahme tschechoslowakischer politisch Verfolgter 1968-69; die Verschiebung von ziviler zu kultureller Wahrnehmung von Zuflucht in der Umsiedlung von indo-chinesischen Flüchtlingen 1975-82; der Asylkompromiss 1992-93 und die vorausgehenden Debatten um nationale Zugehörigkeit; die Aufnahme von Zwangsmigranten aus dem Kosovo 1999-2000; und die Rückkehr zu zivilen Vorstellungen in der Entwicklung eines europäischen Asylsystems seit 2003. Presse, parlamentarische Debatten und Diskussionen im Bundeskabinett sind dabei Gegenstand der Analyse. Die Untersuchung politischer Äußerungen über Zuflucht trägt so zum Verständnis der historischen Entwicklung von Zugehörigkeit bei. Um Vorstellungen von Zugehörigkeit aus politischen Argumenten herauszuarbeiten, wird ein besonderes Augenmerk auf die Verwendung von Erinnerungen gelegt und wie in jenen Beziehungen zwischen deutscher Zugehörigkeit und denen die Schutz suchen konstruiert werden. Die aus dem Projekt resultierende Monographie wird zum ersten Mal die Geschichte der Zuflucht in der Bundesrepublik Deutschland umfassend darstellen. Dabei ermöglicht die Studie, die am weltweit führenden Refugee Studies Centre der University of Oxford angesiedelt ist, nicht nur eine neue Perspektive auf die politische Kultur und Einwanderungsgeschichte in Deutschland, sondern trägt auch zu einem wegweisenden Verständnis von Zuflucht und Asyl bei.

The EU has had its greatest effects on the integration of beneficiaries of international protection (BIPs) through the stable legal framework of the Common European Asylum System (CEAS). The 2013 Reception Conditions and 2011 Qualification Directives build on the standards set by the 1951 Geneva Convention and aim for its full and effective implementation. As presented in the MPG paper “Lost in transition? The European standards behind refugee integration”, they guarantee a series of standards that shape the integration process, starting from the reception phase until full legal, socio-economic and socio-cultural integration allows refugees to realise their full potential to contribute to society. On 13 July 2016, a set of proposals was presented to reform these standards, including to replace the Qualification Directive with a Regulation and to amend the Reception Conditions Directive.1 The social consequences of these proposals are serious. Since BIPs today are fleeing many protracted conflicts that take on average 25 years to resolve2 , our societies will have to live with the consequences of these proposals for years—if not generations—to come. These proposals largely represent a missed opportunity and a potentially major risk for integration. The minor improvements on reception and qualification standards would only marginally improve the situation on the ground in most Member States. Moreover, several of the recast’s proposals would actually delay and undermine the integration process for asylum-seekers and BIPs by reducing support for potentially large numbers and removing some possibilities for more favourable conditions for integration. Unlike the 1 st and 2nd generation of the CEAS, which consolidated the most common national practices in EU law, several of these proposals are modelled on hasty and politicised recent restrictions in only a few Member States. These restrictions have not yet been demonstrated to be justified, proportionate or effective for improving integration outcomes. Overall, national governments and civil society agreed that better implementation of the current Reception and Qualification Directives would have greater effects on integration, without jeopardising the effectiveness of other proposed reforms to the CEAS. Particularly as the Commission’s 2016 asylum proposals were drafted more hastily than previous EU asylum and immigration proposals, these two proposals would need to be revised or seriously amended by Council and Parliament in order to make integration the top priority of this recast and avoid a de facto race-to-the-bottom where Member States are further demanding integration but not effectively supporting BIPs, Member States and the local, social and civil society actors that make integration a reality.

Die soziale Produktion von Räumen in urbanen Asylregimen. Am Beispiel von Frankfurt Rödelheim und Maintal

TRACKS- identification of TRafficked Asylum seeKers’ Special needs is a transnational project that offers to analyze the asylum-trafficking in human beings (THB) nexus through the prism of special needs of trafficked asylum seekers and to equip national asylum authorities and civil society organizations to tackle crosscutting issues (i.e. protection, housing, rehabilitation, psychosocial support as well as security). Indeed, international protection of these asylum seekers might be challenged by their very specific vulnerability. Asylum seekers identified as victims of THB need to benefit from specific social and judicial support and reception conditions, as well as from a procedure that should be adapted to their individual specific situation. These needs have to be addressed to allow them to benefit from an appropriated international protection by EU member States. Very few victims of THB applying for asylum are granted refugee status or subsidiary protection as they have enormous difficulties to express their individual story because they are most of the time under influence, are not always aware of their rights in relation to their specific situation and went through traumatic experiences. Moreover, the asylum application can be used by criminal networks exploiting victims to make sure they legally stay on the territory. The situation of this specific vulnerable group requires a very specific answer that will result from a complementary accompaniment from a range of actors (i.e. regarding social and legal support, health, security issues, etc.).
