Poetics of Statelessness in Twentieth-Century France and Europe

Description
Offering the first comprehensive analysis of the phenomenon of statelessness in the context of twentieth-century French-language and European poetry, this project will result in two outputs / activities. These are: i) a monograph publication devoted to four important French-language poets of the period who engage with the problematic of statelessness and ii) an international workshop entitled ‘The Language of the Stateless’ exploring the theme’s pertinence within modern and contemporary poetry in a broader European context, leading to publication of a volume which the experienced researcher, Dr Greg Kerr, will edit. The monograph blends theoretical discussion (based on philosophical sources such as those by Jacques Rancière and Hannah Arendt) with digitally-informed textual analysis, focussing on the specific linguistic features of works by four poets: Armen Lubin, Gherasim Luca, Edmond Jabès and Michelle Grangaud. It will draw significantly on intellectual and institutional resources in digital textual databases and the study of modern poetry and language acquisition at the Analyse et Traitement Informatique de la Langue Française research laboratory, part of the Centre National de la Recherche Scientifique, Nancy, France. The workshop and subsequent publication will provide a much-needed networking opportunity for European researchers who are working on statelessness, modern poetics and intercultural experience in their specific national contexts. Each strand of the project draws significantly on digital humanities resources and combines elements of individual interdisciplinary research, skills training and public engagement activities.

Description
On the basis of international law and subject to their treaty obligations, states have the right to control the entry of foreign nationals into their territories. However, when dealing with individuals seeking international protection, a state’s margin of appreciation is narrower. In this case, indeed, the freedom of each sovereign should be exercised in accordance with human rights standards and should guarantee the highest level of protection. After discussing the development of human rights and asylum policies in the European Union, this paper examines Directive 2003/9/EC of 27 January 2003, laying down the minimum standards for the reception of asylum seekers in the light of human rights obligations and tries to determine whether this legal instrument contributed to the establishment of the Common European Asylum System. In addition, assessment of Commission’s proposals will be provided in order to establish whether future amendments will be essential in providing asylum seekers with the highest level of protection and in setting common standards in the EU reception area.

Legal Aspects of Irregular Migration in Turkey

Turkey receives ever-increasing numbers of irregular migrants from its economically and politically unstable East and South trying to cross its territory towards Europe. Turkey has also experienced dramatic economic and social change. Therefore, with regard to international migration Turkey, once regarded as a sending country, has become a transit as well as a destination country. There are various categories of irregular migrants which may overlap. A smuggled, even a trafficked, migrant may seek asylum in Turkey. An asylum seeker may become an irregular employee. An irregular employee may apply for asylum. Similarly, someone who was heading for Europe through Turkey may get stuck in Turkey and be forced to start employment without a valid work permit. A rise in ‘irregular’ migration is an issue of concern in Turkey. Irregular migration has been perceived as having social, economic and security consequences. Restrictive legislation and reinforced control mechanisms have been introduced by Turkey over the years. International law and EU instruments are part of this legislation. 2003 was a milestone in coping with irregular migration since most of the legislation was adopted in that year and immediately afterwards. It should also be noted that despite Turkey’s restrictionist stance an intensification of global and regional disparities has brought about more irregular migration and, given the magnitude of the problem, the solutions are beyond the control of a single country, requiring international cooperation and coordination.

Legal Framework of Migration in Sudan

This paper examines the various legal aspects of migration in Sudan and focuses on the regulatory framework in the last decade. It looks at legislations and regulations, which are organized around key elements of the migratory process, analyzing the national laws in several legal documents including the 2005 Interim National Constitution of the Republic of the Sudan (INC 2005), national laws, regulations and decrees. The paper falls into three main parts while focusing on three categories: refugees and asylum seekers; the legal framework governing foreign nationals or aliens; and, finally, legal issues governing nationality and citizenship. The paper concludes by arguing that the migratory situation in Sudan has changed in the past decade for various reasons including increased foreign investments (which have attracted international corporations and foreign laborers) as well as the relaxation of immigration rules, allowing particularly Arab and Muslims groups to enter Sudan that they see as a haven. Asylum seekers and refugees entering Sudan in large numbers have also proved to be problematic. The migratory situation in Sudan, this paper argues, has not been matched with adequate rules and regulations to cope with the new realities. / Cette note analyse les divers aspects juridiques de la migration au Soudan, en s’appuyant sur le cadre juridique de la dernière décennie. Elle examine les législations et réglementations qui régissent les éléments clé du processus migratoire. Elle se base sur l’étude des règles nationales existantes, incluant la Constitution nationale provisoire de la République du Soudan de 2005, les lois, règlements et décrets nationaux. La note est divisée en trois parties selon trois thèmes : réfugiés et demandeurs d’asile ; cadre juridique régissant les étrangers ; nationalité et citoyenneté. La note conclut que la situation migratoire au Soudan a changé ces dix dernières années du fait de plusieurs facteurs, au nombre desquels le développement des investissements étrangers (attirant des entreprises et des travailleurs étrangers) ainsi que l’assouplissement de certaines règles d’immigration en particulier celles permettant aux Arabes et musulmans de trouver un refuge sûr. La question des demandeurs d’asile et des réfugiés entrant au Soudan est également problématique. La réglementation actuelle ne semble pas à même de répondre aux nouvelles réalités de la situation migratoire au Soudan.

Readmission, return and reintegration : the Russian Federation

The acceptance of Russian citizens residing abroad and returning to Russia voluntarily or by force is not so relevant for the Russian Federation (although, obviously the problems of their integration are underestimated and ignored), as are the issues of the return of foreign citizens and stateless persons, especially those who violated national legislation, or under readmission agreements. The problem is aggravated by the fact that, readmission agreements have not been signed with most of the donor states from which migrants arrive to Russia on a massive scale. In fact, most of the migrants arrive from the countries that have visa-free regimes with the Russian Federation. The latter circumstance, allied to the inefficient organization of expulsion of undesired foreigners from the country, provokes the growth of xenophobic spirit and the popularity of suggestions to introduce visa regimes with donor states; above all, with Central Asian and Transcaucasian states. It is probably fair to say that governmental institutions as well as non-governmental organizations in Russia should pay more attention to the issues of voluntary return of foreign citizens to their countries of citizenship or permanent stay.

Situasjonen i Nederland vil bli brukt som et komparativt eksempel. Studien er basert på intervju med 25 personer som arbeider med enslige, mindreårige asylsøkere på forskjellige nivå i privat og offentlig virksomhet i Norge og i Nederland.

A number of questions must be addressed in finding the best policy response to this tragedy. Do smuggled migrants resemble regular asylum seekers and migrants or do they represent a specific group? De hoge instroom van asielzoekers in 2015 heeft het migratievraagstuk op de maatschappelijke agenda geplaatst. Er zijn soms sterke meningsverschillen tussen voor- en tegenstanders. Dit onderzoek focust op het draagvlak onder de Nederlandse bevolking voor verschillende aspecten van het Nederlandse migratiebeleid. De onderzoeksvraag is: Welke factoren beïnvloeden de mate van maatschappelijk draagvlak voor de verschillende aspecten van het migratiebeleid in Nederland, en in hoeverre kunnen die factoren worden ingezet om maatschappelijk draagvlak voor die aspecten te behouden dan wel versterken? Het onderzoek bestaat uit drie delen. Het eerste deel betreft een literatuurstudie waarin is nagegaan welke processen het draagvlak voor migratiebeleid bepalen. Het tweede deel betreft een enquête naar draagvlak onder een grote steekproef Nederlanders. Het derde deel bestaat uit telefonische interviews onder 80 deelnemers aan de enquête , waarbij het doel was om beter inzicht te krijgen in de redenen waarom men zo over deze beleidsmaatregelen en hun uitvoering denkt.
