Doel van het onderzoek is inzicht te krijgen in wat het vreemdelingenbeleid kan doen om Nederland aantrekkelijk(er) te maken voor kennismigranten en meer in het bijzonder wat de IND en andere betrokken partijen kunnen doen om de dienstverlening richting kennismigranten te verbeteren. Het onderzoek geeft inzicht in de redenen van kennismigranten om voor Nederland te kiezen en hun ervaringen met het Nederlandse toelatingsbeleid en de dienstverlening. Onder kennismigranten verstaan we alle hooggekwalificeerde arbeidsmigranten van buiten de EU/EER die in Nederland aan de slag zijn als kennismigrant. Dit zijn bijvoorbeeld hoogopgeleide managers of ICT-specialisten, maar ook wetenschappelijk personeel zoals aio’s, onderzoekers of docenten rekenen we tot deze groep. Naast inzicht in de keuzes en ervaringen van kennismigranten zijn in dit onderzoek concrete aanknopingspunten geformuleerd voor het verbeteren van de dienstverlening aan kennismigranten, wat uiteindelijk de aantrekkelijkheid van Nederland als vestigings- en carrièreland ten goede kan komen.

Country Report: Indian migration to the Netherlands

This paper presents the past and present state of affairs regarding migration from India to the Netherlands. The Netherlands have never been a very popular destination for migrants from India. If we, however, include the Hindustanis in the so-called Indian diaspora, the Netherlands are home to the second largest Indian diaspora in Europe. The Hindustanis are the descendants of British-Indian indentured laborers who migrated to the Dutch colony of Surinam between 1873 and 1916, and who moved on to the Netherlands in particular during the 1970s and 1980s. At present, the "Indian diaspora" in the Netherlands includes approximately 160,000 Hindustanis and 21,729 Indians (first and second generation immigrants). This paper deals with all those with apparent (ancestral) connections to India. Two phenomena stand out and make the Dutch case particularly interesting for a study of Indian migration to Europe. Besides the presence of the relatively large group of Hindustanis, we are currently witnessing a remarkable increase in the immigration of Indian knowledge workers in the country. In practice, the two distinct categories of people of Indian descent have very little in common. This paper investigates these different categories of ("old" and "new") migrants and analyzes the implications of contemporary Indian and Dutch policies on Indian migration to the Netherlands and on processes of identity formation amongst these migrants of Indian origin.

Op 1 maart 2017 is een aantal anti-terrorismewetten in werking getreden, waaronder de wijziging van de Rijkswet op het Nederlanderschap (RWN) in het belang van de nationale veiligheid. Door de toevoeging van artikel 14, vierde lid, aan deze wet, kreeg de minister van Justitie en Veiligheid (JenV) de daarop volgende vijf jaar de bevoegdheid om het Nederlanderschap te ontnemen van uitreizigers die zich vrijwillig hebben aangesloten bij een terroristische organisatie die een bedreiging vormt voor de nationale veiligheid. Het gaat hierbij om een preventieve maatregel waartoe de minister zonder voorafgaande strafrechtelijke veroordeling kan beslissen. De legale terugkeer van Nederlandse leden van buitenlandse, jihadistische organisaties naar ons land wordt op deze manier verhinderd door middel van intrekking van hun Nederlanderschap. Met dit onderzoek wordt invulling gegeven aan de toezegging aan de leden van de Eerste Kamer om de wet drie jaar na haar inwerkingtreding te evalueren (Tweede Kamerstukken, Vergaderjaar 2015-2016, 34.356 (R2064), nr. 26). Het betreft een plan- en procesevaluatie.Tijdens de behandeling van de wetswijziging in de Eerste Kamer heeft de toenmalige minister van Veiligheid en Justitie toegezegd dat artikel 14 lid 4 RWN drie jaar na inwerkingtreding zou worden geëvalueerd om vast te stellen of de bepaling na de vervaldatum (1 maart 2022) zal worden gehandhaafd, al dan niet in gewijzigde vorm. In het evaluatieonderzoek staat de volgende onderzoeksvraag centraal: In hoeverre heeft de invoering van artikel 14 lid 4 RWN de legale terugkeer van Nederlandse leden van buitenlandse, jihadistische organisaties naar Nederland door middel van intrekking van hun Nederlanderschap weten te verhinderen? Ter beantwoording van die vraag is een planevaluatie en een procesevaluatie uitgevoerd.

Een advies over de komst van asielzoekers uit door Nederland als veilig aangemerkte landen. Waarom dienen zij een asielaanvraag in, terwijl de kans op inwilliging nihil is? Uit het onderzoek is gebleken dat motieven voor personen om uit veilig aangemerkte landen te vertrekken zeer divers zijn en een krachtige drijfveer vormen voor migratie naar ‘Europa’. Die motieven komen bijvoorbeeld voort uit een gebrek aan perspectief in eigen land – armoede, werkloosheid, ongelijkheid – versterkt door gebrekkig bestuur en corruptie en zijn krachtiger dan de aantrekkingskracht van Nederland. Nederland is dan ook vaak niet de eerste bestemmingskeuze. Tijdens de reis ontstaan meer pullfactoren voor Nederland, die vaak zijn ingegeven door verhalen van landgenoten over Nederland. Op basis van dit onderzoek doet de ACVZ de volgende aanbevelingen: • 1) Pak de grondoorzaken van migratie aan en overweeg legale migratiekanalen. • 2) Zet in op een geharmoniseerde EU-definitie van veilig land en uniforme toepassing ervan. • 3) Verkort de Dublinprocedure en/of doe meer zaken zelf af. • 4) Versterk de inzet op terugkeer. Sinds 2014 heeft Nederland opnieuw te maken met een substantiële instroom van asielzoekers, van wie een belangrijk deel in aanmerking is gekomen voor een verblijfsvergunning. Een belangrijke vraag die zich momenteel voordoet, is hoe de positie van de nieuwe vergunninghouders zich de komende jaren zal ontwikkelen. Een van de vragen die daarbij gesteld kunnen worden, is in hoeverre zij zich blijvend in Nederland zullen vestigen. De volgende onderzoeksvragen staan in dit rapport centraal: 1.Hoe groot was het aandeel emigranten tot en met 31 december 2015 onder vergunninghouders met een asielachtergrond uit het cohort 1995-1999 en wat voor type emigratie betrof het (remigratie dan wel vervolgmigratie)? 2.Op welke achtergrondkenmerken verschillen de vergunninghouders die emigreerden (uitgesplitst naar type emigratie) van de vergunninghouders die eind 2015 nog, of weer, in Nederland woonden? 3.Welke achtergrondkenmerken van de vergunninghouders zijn voorspellers van emigratie uit Nederland in de vorm van remigratie, vervolgmigratie en administratieve verwijdering met onbekende bestemming?

De grote toestroom van asielzoekers in het najaar van 2015 is niet nieuw voor Nederland, maar de context is wel veranderd ten opzichte van het verleden. Het draagvlak voor opvang staat onder druk en er vindt in het publieke debat vermenging plaats van de vraagstukken rondom asielopvang met andere dossiers als integratie en de verhoogde terroristische dreiging. Verdringingseffecten en veiligheidsvraagstukken spelen een grote rol in het publieke debat en de vraag is wat dit betekent voor de ontwikkeling van het draagvlak onder de bevolking als geheel, buurtbewoners die met opvang te maken krijgen, asielzoekers/vluchtelingen, (lokale) bestuurders en professionals.

This paper describes the policy framework regarding the integration of migrants in the Netherlands. The Dutch government has not enacted a specific integration policy but instead has a strategic focus on participation and social diversity in general, with a particular focus on the importance of shared core national values in the integration of migrants. Two particular policy tools are discussed, starting with the compulsory civic integration system, which includes language and cultural elements and is compulsory. Civic integration tests are arranged in the countries of origin and since 2013, migrants have been required to cover the costs of their own courses and examinations. Second, the so-called “participation agreements” are described and discussed, which, in line with the Dutch emphasis on shared national values, aim to enforce acceptance of particular fundamental norms of Dutch society on newcomers. Finally, the report concludes with a brief discussion of the role of domestic organisations in supporting migrants, followed by a succinct overview of the current popular debates concerning migration in the Netherlands.

Worldwide, many migrants leave their countries in search of safety and internation- al protection. In 2015, the number of asylum seekers in Europe reached a peak. Among them were unaccompanied minor asylum seekers (UMAs). The current study aimed to shed light on the push and pull factors that played a role in the flight of the UMAs who arrived in the Netherlands in 2015, to understand the processes through which these minors ultimately ended up in this country, their expectations regarding the intended destination, if any, and their satisfaction with life in the Netherlands – topics about which little is known so far.
