Was konstituiert und kennzeichnet Minder- und Volljährigkeit bei Geflüchteten? Wie macht das Alter bei ihnen einen (aufenthalts-)rechtlichen, politischen und affektiven Unterschied? Diesen beiden Hauptfragen gehen wir in unserem Projekt nach. Es gibt immer wieder heftige öffentliche Debatten zum Alter von Flüchtlingen und zu rechtsmedizinischen Altersschätzungspraktiken, bei denen u.a. Röntgenaufnahmen von Schlüsselbeinen herangezogen und die Genitalien der Jugendlichen inspiziert werden. Denn unbegleitete minderjährige Flüchtlinge haben andere Rechte als erwachsene Geflüchtete: sie haben Anspruch auf einen Platz in einer Jugendwohnung, einen Sprachkurs und schulische Ausbildung. Zugleich müssen sie den Vorgaben pädagogischer Betreuung und denen von Vormündern folgen. Vor allem haben sie andere Möglichkeiten, ihr Bleiben in Deutschland zu organisieren. So ist es beinahe unmöglich, sie abzuschieben. Im Zentrum unserer Untersuchung stehen folgende Dimensionen:1) Klassifikationsprozesse, d.h. die Hervorbringung und Ausprägung der Differenzkategorie Alter in Praktiken der Altersfestsetzung; 2) die Wirkmächtigkeit dieser Klassifikationen, d.h. altersspezifische Zugehörigkeiten, Rechte, Möglichkeiten und Einschränkungen von jungen Flüchtlingen mit dem Status "unbegleitete Minderjährige". Zur Umsetzung unserer Forschungsfragen ist eine ethnographische Langzeitstudie vorgesehen. Darin führen wir an allen wichtigen Stationen des Ankommens von jungen Geflüchteten teilnehmende Beobachtungen durch und interviewen die zentralen Akteure der verschiedenen Verfahren. Hierzu zählen die Erstaufnahme ebenso wie jugendamtliche, pädagogische und rechtsmedizinische Praktiken der Altersschätzung sowie daran geknüpfte Widerspruchsprozesse. Schließlich sollen auch Asylanhörungen beim Bundesamt für Migration und Flüchtlinge in den Blick genommen werden.Grundlegend für die oben aufgeführten Untersuchungsdimensionen ist unser Verständnis der Differenzkategorie Alter als kontingent, situativ und abhängig von spezifischen Praktiken der Hervorbringung. So können wir erforschen, welche Elemente in medizinischen, pädagogischen und bürokratischen Praxen (ir)relevant und entscheidend werden, wenn es um die Frage geht: ist ein Flüchtling minderjährig? Die Wirkmächtigkeit dieser Klassifikation untersuchen wir mit unserem Konzept von politischer Subjektivität, was sowohl Rechte und Handlungsspielräume als auch affektive Zugehörigkeit zusammen denk- und untersuchbar macht.Durch diese erste ethnographische Analyse der Hervorbringung und Wirkmächtigkeit von Alter im Migrationszusammenhang entwickelt das Projekt neue Ansatzpunkte für eine kritische Intervention in den dominanten öffentlichen Diskurs zur Altersschätzung bei jungen Flüchtlingen. Unser Projekt leistet einen theoretischen und empirischen Beitrag an der Schnittstelle von Medizinanthropologie, Wissenschafts- und Technikforschung (STS), Studien zu Flucht und Migration und der Kindheits- und Jugendforschung.

Ce projet explore les tensions dialectiques qui se nouent entre les composantes substantielles (politiques) et les éléments formels (géographiques) de l’identité européenne, à la faveur d’une approche critique des politiques d’asile et d’immigration de l’UE et de ses Etats membres. Approche foucaldienne proposant de regarder comme un banopticon les politiques et normes européennes en matière d'immigration et d'asile: surveiller et bannir semble être l'objet et l'objectif des textes adoptés et normes appliquées pour prévenir les arrivées de migrants ou organiseur leur éloignement, quitte à organiser par la loi la violation des droits fondamentaux et donc des instruments juridiques de protection de ces droits qu'ils soient internationaux, régionaux ou nationaux.

La note de synthèse présente les principaux résultats de l’étude réalisée en 2017 par le Point de contact Luxembourgeois du Réseau Européen des Migrations intitulée : « Défis et pratiques dans l’établissement de l’identité des demandeurs lors des processus migratoires ». Cette étude vise à présenter un aperçu des principaux défis auxquels les autorités compétentes au Luxembourg sont confrontées lors de l’établissement et de la vérification de l’identité des ressortissants de pays-tiers dans le cadre des différentes procédures de migration (asile, retour, migration légale) ainsi que des pratiques mises en œuvre pour relever ces défis. Cette note se base essentiellement sur les informations recueillies jusqu’en juillet 2017 et n’englobe donc que peu d’évolutions qui ont pu se produire après cette date.

Challenges and practices for establishing applicants’ identity in the migration process. Luxembourg.

In Luxembourg, the procedure for identity verification/establishment in the context of international protection is separated from the decision-making procedure as such. While the authority for granting international protection status lies with the Ministry in charge of Immigration (Directorate of Immigration), the Judicial Police is in charge of identity verification/establishment. For this means, the applicant will be interviewed with regard to his/her travel itinerary, including questions on border crossing and used means of transports to arrive in Luxembourg. During the last few years, the large majority of international protection applications in Luxembourg have come from persons originating from the Western Balkan countries (in 2016 they represent 35% of the applicants). Concerning these applicants, most of them (85% to 90%) have presented valid identity documents to the authorities in Luxembourg. However, with the migration crisis there is a growing number of international protection applicants coming from the Middle East and North Africa and who cannot produce valid identity documents. National authorities have always been confronted with lacking identity documents, predominantly observable among applicants from African countries. In some cases, identity documents were intentionally destroyed or withheld from the authorities in order to avoid being identified. If credible identity documents are lacking, the identification procedure can become complicated and resource consuming, and the responsible authorities, especially the Police, have a limited set of methods and means available (provided for in the Asylum Law).
