Le Niger n’est pas un pays de prédilection pour les étrangers, qui représentent 1% de la population totale. A part les agents diplomatiques et consulaires, on trouve trois catégories d’étrangers. Les immigrants résidents ressortissants des pays membres de la CEDEAO peuvent entrer sur le territoire nigérien sans visa mais doivent comme tous les étrangers faire une demande de permis de séjour. La plupart ne se soumet pas à cette procédure qui est la condition nécessaire d’un séjour régulier. Ils ont en réalité une perception erronée du principe de libre circulation et le laxisme des pouvoirs publics les conforte dans cette position. Une législation extrêmement contraignante en matière de travail pousse les immigrants résidents vers le secteur informel où leur protection sociale n’est pas assurée. Les migrants en transit constituent des flux migratoires importants qui utilisent le territoire nigérien comme couloir de passage vers les pays du Maghreb et l’Europe. Ils sont pour la plupart originaires de l’espace CEDEAO et traversent facilement le Niger, mais, une fois arrivés aux postes frontaliers extérieurs, ils sont en proie à toutes sortes de difficultés.Les réfugiés ont vu leur nombre baisser de façon considérable. Ceux qui sont reconnus par l’Etat du Niger ont théoriquement les mêmes droits que les Nigériens. Ce principe d’égalité n’est qu’une façade, la réalité est peu reluisante pour ces réfugiés qui ont du mal à trouver un travail, «nigérisation» des postes d’emplois oblige. Niger is not a country of choice for foreign nationals, who represent only 1% of the population. Apart from diplomatic and consular officials, there are three categories of foreign nationals. The first are resident immigrants. Those from ECOWAS countries, can enter Niger without any visa, but have to apply for a residence permit like other foreign nationals. Most of them do not follow this procedure, the condition for a regular stay. They have a mistaken perception of the free movement principle and this is confirmed by the Nigerien government’s laxity. Extremely restrictive labour regulations drive resident immigrants to the informal sector where social protection is not guaranteed.Important numbers of transit migrants use Niger’s territory as a corridor towards the Maghreb and Europe. They mostly come from ECOWAS countries and easily cross Niger, but face all kind of difficulties at external border posts. The number of refugees has sharply decreased. Those who are recognized by Niger as refugees are supposed to benefit from the same rights as nationals. This equality principle is though barely implemented and refugees do not generally find a job because of the “Nigerienization” of employment.

La migration hautement qualifiée est un des catalyseurs de la dynamique et de la vitalité de l’économie mondiale. Bien que classé au dernier rang par le rapport 2009 sur le développement humain du PNUD, le Niger ne fait pas exception et draine de plus en plus de cadres hautement qualifiés de la sous-région d’Afrique de l’Ouest et centrale, d’Europe et d’Asie en raison des opportunités économiques qu’offrent ses ressources minières et pétrolières. Dès lors l’ampleur qu’a pris ce phénomène au cours des dernières années au Niger ne saurait laisser le sociopolitologue indifférent. Nous nous sommes efforcés de montrer dans cet article que les enjeux de la migration hautement qualifiée au Niger ne peuvent être compris qu’à partir d’une analyse approfondie du contexte dans lequel elle se produit, et des interactions entre les acteurs en présence. Abstract Highly skilled migration increasingly became one of the driving factors of the world economy. Although Niger was ranked in the 2009 UNDP human Development Report as the worlds’ poorest country, the emigration of highly qualified nationals is on the rise and contributes to draining human capital away from the country. Therefore, the scale and dynamics of this particular type of migration have become throughout the last years significant research topics for socio-political analysts. In this paper, we argue that the challenges raised by highly skilled migration in Niger cannot be understood without first analysing in depth the context in which it takes place, and the different interactions among stakeholders.

L’analyse dans une perspective socio politique de ce cadre laisse apparaître que l’efficacité et l’efficience de ces institutions et instruments sont entravées par deux contraintes majeures : (i) les défis de développement du Niger qui occultent l’importance de la migration et font que ce phénomène n’occupe pas encore la place qui est la sienne sur l’agenda des décideurs et (ii) l’absence subséquente d’une politique nationale en matière de gestion des flux migratoires ainsi que d’un cadre stratégique de son opérationnalisation. / The general framework of migration to, towards and through Niger is characterized by a set of institutions and of relevant national and international legal instruments. The socio political analysis of this framework reveals that the efficiency of these instruments and institutions are hindered by two major constraints : (I) The development challenges of Niger which hide the importance of the migration and make that this phenomenon does not still occupy the place which is his on the agenda of the decision-makers and (ii) the subsequent absence of a national policy on migration as well as a strategic framework for its implementation.

Le statut juridique de la femme a des conséquences sur l’émigration des Nigériennes. En fait, très peu de femmes au Niger émigrent à l’étranger pour y travailler car c’est une question d’hommes, l’émigration a toujours été masculine. En revanche, beaucoup de femmes d’origine étrangère viennent au Niger pour y travailler. La grande majorité de ces immigrantes travaillent dans le domaine de la domesticité où le travail est très peu rémunérateur et n’exige pas de qualification. A côté de ces immigrantes nous assistons depuis quelques années à l’apparition d’une migration féminine interne de travail constituée de jeunes nigériennes qui désertent les campagnes au profit des centres urbains. Il faut dire que la famine consécutive à des longues périodes de sécheresse et la pauvreté ambiante ont favorisé ces types de déplacement qui répondent en définitive à des stratégies de survie. Sur le plan juridique, il n’existe pratiquement pas de textes spécifiques à la migration féminine de travail, mais plutôt à la règlementation du travail des femmes en général et du travail domestique en particulier. Ce sont des textes fragmentaires et très discriminatoires qui ont besoin d’un toilettage conséquent et approprié, mais pour cela il faut une mobilisation des femmes et une réelle volonté politique. / The legal status of women has had an impact on the emigration of Niger women. Very few women from Niger actually emigrate abroad to work. Emigration has always been seen as a male activity. Nevertheless, many foreign women come to work in Niger. Most of them work as domestics, a low paid sector that needs no qualifications. Beside these immigrants, internal female migration has started up in the last years, with young Niger women leaving the countryside to live in urban centres. The starvation following long periods of dryness and general poverty have fostered these kinds of mobility which are essentially survival strategies. On the legal level, there is no specific text relating to female labour migration, but there are laws regulating female labour in general and domestic work in particular. These are partial and very discriminatory texts, which need important reforms and therefore demand women’s mobilisation and a real political will.

Les mouvements migratoires ne sont pas neutres vis-à-vis du genre. Et en dépit de la féminisation significative des flux migratoires au cours des dernières années, et des enjeux qu’elle suggère, les recherches sur le genre et la migration en Afrique subsaharienne sont limitées par le manque d’informations et de données sur les relations de genre dans la dynamique et l’évolution des flux migratoires. Aussi, la présente étude se propose-t-elle de montrer, à la lumière des données de terrain, que les facteurs socioculturels, notamment les perceptions, les rôles et les responsabilités construites par la société et attribués aux femmes et aux hommes dans une culture et un espace donné, influencent de manière significative la décision de migrer, les impacts possibles, socio-économiques et culturels, des politiques migratoires et des migrations. Les constructions socioculturelles peuvent donc limiter ou favoriser les possibilités de capitalisation des opportunités et d’optimisation des ressources productives que l’entreprise migratoire offre aux hommes et aux femmes. / Migration is not neutral towards gender issues. Despite the significant feminization of migration flows and the issues raised by this phenomenon during the last years, academic research on gender and migration in Africa is limited, above all because of a lack of data. On the basis of my fieldwork in Niger, I argue that the gendered role of men and women in a given society and environment significantly influences migration policies, migration and its potential cultural and socioeconomic impact. In other words, the social and cultural constructions and perception of roles and responsibilities of men and women can limit or facilitate the range of opportunities offered by migration.

De récentes études ont montré qu’au cours des 20 dernières années, les flux de migrants en situation irrégulière depuis et vers le Niger n’ont cessé d’augmenter. Le potentiel de croissance économique du pays et les opportunités d’investissement dans le secteur tertiaire, l’énergie, le tourisme, l’hôtellerie et l’artisanat utilitaire laissent présager une accélération de cette tendance. La présente étude examine à la lumière des données existantes ainsi que de celles recueillies au cours d’entretiens avec de jeunes candidats à l’émigration vers le Maghreb et l’Europe : (i) les déterminants de la migration irrégulière ; (ii) les politiques publiques mises en place pour lutter contre ce phénomène en Afrique et en Europe et leurs limites. Pour conclure, nous formulons quelques recommandations pour une maîtrise efficace de ces flux. Abstract Recent studies reveal that Niger has been, for about two decades, a privileged space for illegal migration to North Africa and Europe. Job opportunities in many sectors in Niger such as services, mines and energy, tourism and artisanship indicate that these illegal movements will increase. In this paper, we analyze, in the light of the existing data as well as of data collected during interviews with potential illegal migrants towards the Maghreb and Europe: (i) The driving forces behind illegal migration ; ii) policies concerning the phenomenon in Africa and in Europe and the limits of these policies ; and iii) we conclude with some recommendations for an effective control of illegal migration flows.

Migrations hors et vers le Niger : Une analyse selon le genre

L’étude des migrations selon le genre s’impose en ce sens qu’elle permet de mettre en évidence certaines inégalités et iniquités entre hommes et femmes, ainsi que les progrès accomplis ou non vers leur réduction. Ainsi, la présente étude portant sur les migrations internationales hors et vers le Niger a permis de faire ressortir certains faits intéressants montrant notamment que, concernant l’immigration, les femmes sont également concernées et peuvent poursuivre leurs propres objectifs dans le domaine de la mobilité internationale. Concernant la population nigérienne résidente dans les pays de l’OCDE, la proportion des femmes se rapproche de celle des hommes en France (49%), principale destination de la zone, pour 66% des émigrants nigériens ; une forte présence féminine (43%) est également observée pour l’ensemble des pays membres. Cependant, au niveau du marché de travail de cet espace développé, les femmes ne représentent que 35% de l’effectif des actifs employés. Par rapport à la situation dans l’emploi, les émigrées nigériennes montrent une situation très défavorisée : le taux d’activité selon le sexe diffère largement en passant de 74% parmi les hommes à 59% chez les femmes ; le taux de chômage est même plus défavorisant en atteignant 25% pour les femmes (vs 15% chez les hommes). Enfin, elles occupent principalement des emplois peu qualifiés : 58% travaillent dans les secteurs de la santé, du travail social, de l’éducation et d’autres services. S’agissant de la population étrangère résidente au Niger, les résultats suivants méritent d’être soulignés : l’effectif des femmes est très proche de celui des hommes. De même, certaines provenances géographiques principales sont dominées par les femmes (Togo, Ghana et Bénin) lesquelles sont devenues progressivement plus nombreuses en ville que les hommes. Par ailleurs, elles s’intéressent de plus en plus au marché de travail même si la majorité d’entre elles sont encore sans emploi. Quant à leur profil socioéconomique, elles ont un faible niveau d'éducation et sont employées principalement dans des occupations peu qualifiées. / A gender approach in migration studies shows the inequalities between the sexes and the evolution of these inequalities. This study focuses on the gender dimension in international migration in and from Niger and aspects of Nigerien migration pertaining to this. As far as emigration patterns are concerned, women seem to have, today, the same propensity to emigrate and independent emigration has been rising among them. In OECD countries, Niger women represent 43% of all emigrants, 49% in France, the OECD country which hosts the majority of Nigerian emigrants (66%). However, their socio-economic profile shows that women represent only 35% of the total active Nigerien population. In the labour market, meanwhile, Nigerien women are in a very disadvantaged position with respect to their male counterparts : the activity rate equals 74% for men and drops to 59% among women ; the rate of unemployment is 25% for women and 15% for men. Finally, Nigerien women residing in OECD countries are mainly employed in low-skilled occupations : 58%, indeed, are concentrated in the health, social work, education and other service sectors. As to foreign nationals residing in Niger, there is gender parity, and some foreign communities (e.g. Togo, Ghana and Benin) are made up predominantly of women. Women have gradually acquired increasing importance in urban centers, where their participation in the labor market is rapidly increasing. As to their profile, female foreign nationals in Niger tend to be poorly-educated and are employed in low-skilled occupations.

L’émigration internationale des Nigériens se fait pour l’essentiel dans les pays de l’espace CEDEAO où il existe des règles communes prévues pour tous les ressortissants de cet espace en matière de libre circulation, d’établissement et de résidence. Le séjour des Nigériens à l’étranger devient une préoccupation majeure en cas d’expulsions collectives massives dont ils sont quelquefois victimes dans certains pays d’accueil. Ces expulsions ne sont accompagnées d’aucune indemnisation. Cette situation pose avec acuité le problème de la protection des migrants et de leurs biens. Il faut déplorer le vide juridique en matière d’expulsions collectives et les textes régissant les expulsions collectives ainsi que ceux régissant les expulsions ou rapatriements individuels sont faibles et ineffectifs. Les immigrants qui séjournent au Niger doivent se conformer aux dispositions réglementant leurs conditions d’entrée et de séjour. Les étrangers résidents ont les mêmes droits que les nationaux tels qu’ils sont décrits par les textes en vigueur. Cependant certaines restrictions existent en matière électorale, d’accès à la fonction publique, d’hébergement, d’activité salariée et non salariée. Les migrants en transit majoritairement ressortissants de l’espace CEDEAO utilisent le Niger comme pays de transit (aucun visa n’est exigé). Le principe de libre circulation est un bon instrument d’intégration régionale, mais il s’arrête aux frontières des pays du Maghreb qui ont des exigences différentes en la matière (instauration généralisée de visas, expulsions massives notamment en Libye) ; du coup les migrants en transit se retrouvent dans une situation irrégulière très préjudiciable pour eux. / Nigeriens generally emigrate to ECOWAS member states, where common rules enable free circulation, establishment and residence to all citizens. The stay of Nigeriens abroad becomes a worry in case of massive collective expulsions, as occurs from time to time in some receiving countries. These expulsions involve no financial compensation and call into question the protection of migrants and their property. We regret the lack of regulations regarding collective expulsion, and the texts governing collective expulsion as well as individual expulsion and repatriation are weak and ineffective. Immigrants in Niger have to respect provisions concerning entrance and stays in the country. Foreign residents have the same rights as nationals, with some exceptions regarding elections, access to the civil service, accommodation, access to employment and self-employment. Transit migrants, mostly from ECOWAS countries, often pass through Niger as no visa is required. Free movement is a means of regional integration, but it stops at the borders of Maghreb countries, which have different rules in this regard : generalized visa requirement, collective expulsions, especially from Libya. As a matter of fact, transit migrants find themselves in an irregular and thus difficult situation.

Les migrations hautement qualifiées du et vers le Niger : Etats des lieux et tentatives explicatives

L’intérêt pour les migrations des personnes hautement qualifiées (HQ) s’est accru ces dernières années aussi bien au niveau de la recherche que du débat public. La migration des personnes HQ est au cœur de nombreuses controverses concernant ses effets positifs ou négatifs pour les pays de départ comme les pays d’accueil. Si l’on considère la faible disponibilité de données statistiques, ce travail pionnier pour le Niger a permis de faire ressortir d‘importants résultats. Bien qu’ils ne représentent que quelques 0,8% de la population totale du Niger, les immigrants étrangers apportent une contribution plutôt positive à l’économie nigérienne, à travers la création d’entreprises et donc d’emplois. En effet, 5% des entreprises agréées sont détenues par des étrangers. Dans le secteur des industries extractives, cette proportion atteint 31%. Ont peut également mentionner le fait que parmi les entrepreneurs non nigériens, les Européens et les Asiatiques - pourtant minoritaires dans la population étrangère totale – détiennent environ 44% du total des entreprises enregistrées au nom d’étrangers. Quant à l’émigration hautement qualifiée, le Niger est beaucoup moins touché par le phénomène plus connu sous le nom de «fuite de cerveaux » que nombre de ses voisins africains. Cependant, les Nigériens HQ représentent presque la moitié du stock des immigrants d’origine nigérienne résidant dans les pays de l’OCDE. Cette émigration ne cesse de prendre de l’ampleur et est en grande partie justifiée par les faibles opportunités d’emploi des secteurs privés et publics. Cette forte émigration des compétences, que ne cesse de prendre de l’ampleur, est le produit de l’interaction de plusieurs facteurs, parmi lesquels on mentionne l’augmentation d’emploi informel ainsi que la manque d’opportunités de travail dans le secteur public et privé. The interest in highly-skilled migration has grown both in academic and public debate. Specifically, its role in negatively or positively affecting origin as well as host countries is much discussed. Notwithstanding the scarcity of statistical data, this pioneer work presents and discusses recent findings. First, despite their relatively low numbers (0.8% of the total population), immigrants make an important contribution to Niger’s economy through enterprise creation and a consequent increase in labor demand. 5.0% of registered enterprises are owned by foreign nationals and in the extractive sector, this percentage stands at 31.0%. Among foreign entrepreneurs, European and Asiatic immigrants – who represent the minor part of the foreign population in Niger – own 44.0% of registered foreign-owned enterprises. Regarding the opposite phenomenon, highly-skilled emigration is not seen as having a strong impact on Nigerien society. However, almost half Nigeriens residing abroad are highly-skilled. This phenomenon is likely to grow and depends on the interplay of several factors, including an increase in informal employment and the lack of employment opportunities both in the private and in the public sector.

Le Niger a conclu des accords bilatéraux avec certains de ses voisins et des pays amis. Ces accords dégagent les principes généraux contenus dans la Déclaration Universelle des Droits de l’Homme de 1948. Ce sont par conséquent des principes universels de libre circulation des personnes, d’égalité, de non-discrimination, de droit de résidence sur la base de la réciprocité. Il y a là une approche commune des Etats contractants de favoriser la mobilité des populations en assouplissant autant que possible les règles d’établissement et d’exercice des activités professionnelles. Cependant, certaines dispositions marquent le souci des gouvernements de protéger les nationaux en soumettant un certain nombre d’activités à restriction. Il faut également souligner que les accords bilatéraux sont en cohérence avec les dispositifs juridiques de la CEDEAO dans la mesure où ces accords bilatéraux ne sont pas moins favorables que ceux de la CEDEAO. De nouveaux enjeux sont soulevés et préoccupent de plus en plus les acteurs impliqués dans le processus migratoire. Niger has concluded bilateral agreements with some of its neighbours and some allied countries. These agreements confirm the general principles found in the 1948 Universal Declaration of Human Rights. These universal principles include the free circulation of persons, equality, non-discrimination, and the right of residency on a reciprocal basis. There is a common approach between contractive states in favouring the mobility of populations with flexible rules for professional activities and for establishment. Yet, some provisions show how governments wish to protect their nationals by restricting a number of activities. Bilateral agreements are coherent with ECOWAS legal mechanisms as long as they do not provide fewer opportunities than these same mechanisms. New stakes have appeared and have increasingly worried persons involved in the migratory process.

Dynamique des migrations de retour au Niger de 1988 à 2001

La présente étude vise essentiellement, sur la seule base des données des recensements de la population et de l’habitat (RGPH) recueillis en 1988 et en 2001, à approfondir les connaissances sur les caractéristiques des migrants internationaux nigériens de retour. Aux termes des multiples analyses produites, l’étude relève que la proportion de migrants retournés au Niger n’a pratiquement pas changé entre les deux dates et qu’elle compte toujours parmi ses rangs une majorité d’hommes. De même, la plupart des migrants reviennent toujours de l’Afrique de l’Ouest vers laquelle les départs sont également les plus nombreux. Cependant, l’étude a noté des changements importants. En premier lieu, le schéma géographique de la migration de retour a quelque peu changé. En effet, les retours d’Afrique du Nord (notamment de la Libye) et de l’Asie (en l’occurrence de l’Arabie Saoudite) ont pris un peu plus d’importance entre 1988 et 2001. En second lieu, les migrants se sont davantage urbanisés (ou encore on retrouve un peu plus d’urbains), même s’ils retournent vivre en majorité en milieu rural. En troisième lieu, leur niveau d’instruction a sensiblement augmenté entre les deux dates de recensement - même si la majorité d’entre eux ne dispose d’aucune instruction moderne et travaille dans le secteur primaire traditionnel (agriculture et élevage). Abstract This paper analyzes international return migration patterns in Niger as well as the profiles of return migrants. To this end, the two national censuses of 1988 and 2001 are employed and results are compared so as to examine the evolution of the phenomenon. Some characteristics are found to have remainremained unchanged between the two dates, e.g. the proportion of return migrants in the population as a whole, migrant profile by sex and last country of residence abroad – for the vast majority are men who resided in other Western African countries. However, some features have varied. So some countries of last residence acquired importance among return migrants in this period including Libya and Saudi Arabia. Then even if the majority of return migrants lived in a rural milieu in 2001 the proportion of those who returned to an urban setting increased slightly. Finally, recent return migrants show a higher level of education despite the fact that most are still illiterate.

Les conclusions de ce rapport de synthèse s’inscrivent dans le module juridique de la recherche transversale menée dans le cadre du CARIM sur le thème Genre et Migration. Elles sont basées sur les informations et les considérations présentées dans les rapports nationaux concernant l’Algérie, l’Egypte, le Liban, la Jordanie, le Mali, le Maroc, la Mauritanie, le Niger, la Palestine, le Sénégal, le Soudan, la Syrie et la Tunisie. La recherche visait à évaluer l’impact des facteurs juridiques sur la migration féminine. Les rapports nationaux révèlent clairement la rareté de dispositions juridiques spécifiquement destinées aux femmes migrantes. Les dispositions juridiques concernant les femmes en général et susceptibles d’affecter les femmes migrantes sont en revanche nombreuses. De même, les dispositions juridiques apparemment neutres en termes de genre mais affectant en réalité les femmes et en particulier les femmes migrantes sont innombrables. Ni les législateurs ni les autorités en charge de l’application de la loi ne prennent le genre suffisamment en considération. Pourtant, l’adoption d’une approche sensible aux possibles effets de la loi sur la condition des femmes migrantes, ainsi qu’une attention accrue à l’application des dispositions juridiques constituent des éléments pouvant grandement contribuer à l’amélioration de la condition des femmes migrantes et des droits des migrants en général. Abstract The findings presented in this synthesis paper concern the Legal Module of CARIM transversal research on Gender and Migration, and are based on information and considerations found in the national papers from Algeria, Egypt, Lebanon, Jordan, Mali, Morocco, Mauritania, Niger, Palestine, Senegal, Sudan, Syria and Tunisia. The research aimed to assess the impact of the legal factor in women’s migration. The national papers clearly show that legal provisions specifically concerning migrant women are extremely rare ; legal provisions, concerning women in general which are likely to have some specific effect on migrant women, are numerous ; and legal provisions which are apparently gender blind but actually affect women, and more specifically migrant women, are innumerable. Neither legislators nor officials charged with the implementation of laws take gender into consideration enough. Nevertheless, the adoption of a sensible approach to the potential effects of the law on the condition of migrant women, as well as a careful consideration of the implementation of legal provisions, are powerful elements that might greatly improve the conditions of migrant women and the rights of migrants in general.

Regional responses to forced migration : the case of Libya

The 2011 Libyan civil war, part of the wider Arab Spring, triggered considerable population displacements. These displacements included both Libyans and third-country nationals fleeing the country by land, air and sea. Data available for spring/summer 2011 shows that an estimated 1,128,985 people left Libya to seek shelter in Tunisia, Egypt, Niger, Algeria, Chad and Sudan as well as in Malta and Italy. Research has, thus far, mainly focused on the response of the international community (UNHCR and IOM, above all), the European Union and individual countries in dealing with large numbers of displaced persons (Kelly and Wadud 2012, Fargues and Fandrich 2012, Tucci 2012, Forced Migration Review 2012). Less attention has been given to those regional entities of which Libya has been a member. These include: the African Union (AU), the League of Arab States (LAS), the Community of Sahel Saharan States (CEN-SAD), the Arab Maghreb Union (AMU), the Common Market for Eastern and Southern Africa (COMESA) and the Organization for the Islamic Conference (OIC). The aim of this paper is, therefore, to shed light on the (actual and potential) role of these regional organizations in alleviating those fleeing from Libya.

European Management of Migration and Refugees - Consequences for mobility and political stability in transit countries

The project will investigate how policies of migration management and protection systems shape access to protection, education and sustainable livelihoods for refugee populations, refugee mobility (their decision to repatriate, remain or move on to Europe or other third countries) and political developments and political stability in host communities. The analysis will focus in particular on the humanitarian responses and how refugees are provided access to education and sustainable livelihoods. The project will provide recommendations for international interventions to governments and humanitarian organisations on ways to improve current policies of migration management and refugee protection. Recommendations will focus on policy options that give refugees better access to education and sustainable livelihoods, limit tension between host population and refugees, limit secondary mobility and facilitate repatriation when possible. The project will target four countries and regions with large refugee populations: Lebanon (the Bekaa Valley); Jordan (Amman); Uganda (Nakivale); Niger (Agadez). The analysis will draw on existing, high-quality survey data on refugee and host populations in three of the regions, in combination with document analysis and qualitative interviews. We approach the refugee protection systems as systems of practice and aim to describe the structural factors that create opportunities for action for international actors, refugees, local governments and host populations, how the various actors respond to these opportunities (or lack of opportunities), as well as how they understand their own situation and opportunities.

L'attitude des autorités algériennes devant le phénomène de la migration irrégulière

Les migrations irrégulières vers l'Algérie sont de plus en plus denses. L'Algérie est devenue, depuis le début des années 2000, un pays à la fois d'origine, de transit et de destination. Pour le moment, les pouvoirs publics algériens semblent privilégier un traitement policier des migrations irrégulières, en ce sens que, deuxième pays d'Afrique par sa superficie, possédant des frontières communes avec sept pays à la stabilité relative, l'Algérie invoque - et à bien des égards sa position est fondée-, la menace récurrente du terrorisme, de la criminalité organisée et du grand banditisme (notamment le trafic de drogue qui se joue de toutes les frontières, surtout terrestres qui restent très perméables). Pourtant, dans le Sud Algérien, de nombreux ressortissants (20 000 /an au moins) originaires du Niger et du Mali souhaitent entrer en Algérie pour y exercer une activité légale, faire venir leurs enfants et même acquérir la nationalité algérienne. Ces migrants ne sont jamais régularisés mais sont tolérés parce qu'ils constituent une main-d'œuvre docile et peu exigeante. De ce point de vue, l'Algérie, qui a sans doute raison de plaider pour des solutions globales en matière de migrations (régulières et irrégulières) ne pourra indéfiniment occulter le traitement des migrations irrégulières provenant des pays de l'Afrique subsaharienne, notamment des pays frontaliers, ce qui passe d'abord et avant tout par une adaptation de la législation du travail (qui ignore le concept de travailleur migrant en situation irrégulière) et la mise en œuvre de procédures administratives simplifiées pour la régularisation de tous ceux qui ont vocation à vivre en Algérie du fruit de leur travail.

The Libyan Migration Corridor

Since the mid 1990s, the media have directed our attention to the thousands of Southern Sahara Africans who take life threatening risks crossing the Mediterranean Sea and Atlantic ocean. Their numbers on migratory routes leading to Europe are increasing, joining up, especially in the “Libyan crossroad” with North Africans, Egyptians and even Asian migrants on the same quest. This image reflects reality, but only partially so, for it leads one to believe that these migrants cross the Sahara in the hope of reaching Europe. It should be pointed out that one of the main misunderstandings when evoking these migrations flows is to reduce them to the act of crossing the straits of the Mediterranean Sea. Since the 1990s, the Libyan case exemplifies the way the multilateral (EU-Maghreb) or bilateral (Libya-Italy) political negotiations between the two shores of the Mediterranean sea rapidly focus on the figure of the “illegal sub-Saharan migrant in transit”. This simplistic view is dangerous because it erases the historical dimension of the movement of people and its consequences. The Sahara is not merely a desert to be crossed; it is an area that has been shaped for more than half a century by the various migrant, trader or pastoral communities who have contributed to its massive urbanisation and economic development. At the same time, the reorganization of African migration is affected by the inflation of tensions, border and police controls, the diversification of routes between Niger, Chad Sudan and Libya consequently contributes to the perpetuation of transit spaces. There are tens of thousands of these migrants who settle down more or less durably in these new transit areas dependants on opportunity, status controls, and expulsions. But these transit areas have also become places where migrants seek employment, create new economic activities, or develop new skills while working, studying or practicing other tongues. As migration patterns across the Sahara are reconfigured, the impact is more visible in some places. But their durability should not be taken for granted. Villages specialised in the transit economy may easily decline as new diplomatic relations are formed between countries of immigration and third countries.

Der erhöhte Zustrom Geflüchteter und anderer Migrantinnen und Migranten nach Europa in 2015 hat zu erneuten Bemühungen für eine gemeinsame EU-Afrika-Agenda geführt, die sich mit Herausforderungen der Migration befasst. Zahlreiche Treffen, Veranstaltungen und Gipfel wurden (zumindest teilweise) diesem Zweck gewidmet, wie beispielsweise der Valetta-Gipfel in 2015, der G20-Gipfel in Hamburg 2017 und der EU-Afrika-Gipfel in Abidjan in November 2017. Viele bilaterale, regionale und kontinentale Afro-Europäische Rahmenregelungen und Richtlinien gingen diesen politischen Versammlungen voraus und mit ihnen einher. Dennoch funktioniert die aktuelle Herangehensweise – auch durch die EU-Partnerschaftsabkommen – nicht. Der 2018 MEDAM Assessment Report argumentiert, dass die EU-Länder stärker mit afrikanischen Staaten kooperieren sollten. Die Regierungen dieser Staaten werden eher bereit sein, ihre Staatsbürgerinnen und Staatsbürger nach einem abgelehnten Asylantrag in der EU zurückzunehmen, wenn legale Arbeitsmigration eine realistische Alternative darstellt. Eine aktive Auseinandersetzung zwischen afrikanischen und europäischen Ländern fehlt jedoch weiterhin. Kritikerinnen und Kritiker beanstanden einerseits die Tendenz, dass die Migrationszusammenarbeit europäische Interessen in den Vordergrund stellt, die Inkohärenz in der EU-Politikgestaltung und die ausgrenzende Art vieler Gipfel und Veranstaltungen. Andererseits werden afrikanische Regierungen für fehlendes Engagement in der Migrationsgovernance kritisiert. Ein wesentliches Problem ist, wie wenig bezüglich der Interessen, Beteiligung und Akteure bekannt ist, wenn es um die Steuerung von Migration geht – einschließlich Auswanderung (reguläre und irreguläre), Einwanderung und den Umgang mit vertriebenen Menschen. Das Projekt „Die Politische Ökonomie der Westafrikanischen Migrationsgovernance“ will die politischen Dimensionen von Migrationsgovernance und die zahlreichen Akteure (einschließlich zivilgesellschaftliche und subnationale) beleuchten. Dazu untersucht das Projekt wie die Instrumente und Institutionen zur Migrationssteuerung erstellt und implementiert werden, welche Interessen und Akteure einbezogen oder ausgeschlossen sind und welcher gesellschaftlichen Diskurs diese Interessen umgibt. Die qualitative Studie konzentriert sich auf vier Fallstudien – Gambia, Niger, Nigeria und Senegal – und basiert auf Feldforschung, einschließlich halbstrukturierter Interviews in den betreffenden Ländern. Das Projekt ist von Anfang an partizipativ und somit wird eine Veranstaltungsreihe stattfinden, um unsere Ergebnisse mit lokalen Experten in Abuja, Banjul, Dakar und Niamey zu diskutieren. MACIMIDE Global Expatriate Dual Citizenship Database

Description
The MACIMIDE Global Expatriate Dual Citizenship Dataset charts the rules that existed in near all states of the world since 1960 with regard to the loss or renunciation of citizenship after a citizen of a respective state voluntarily acquires the citizenship of another state. The central variable of the Dataset is the dualcit_cat variable. This is a categorical variable whose values may be used to interpret, in broad lines, the position of a country with regards to the expatriate dual citizenship. The dualcit_cat variable reflects what consequences the legislation and legal practice of a country attaches to the voluntary acquisition of a foreign citizenship. The value of this variable depends on a number of criteria, including whether a citizen of the reference country who voluntarily obtains a foreign citizenship automatically loses – in principle – the citizenship of the origin country, and whether a citizen of the reference country can renounce that citizenship. The value assigned to dualcit_cat reflects the position of the country on the 1st of January of the reference year. Any subsequent changes in legislation will be reflected in the dualcit_cat value of the following year and included in updated versions of the Dataset. The dualcit_binary variable is a recoding of the dualcit_cat variable. This variable can be used for broad comparisons of the dual citizenship positions around the world. The possible values reflect whether the legislation of a country, in a given reference year, provides for the automatic loss of the origin citizenship (1) or not (2). All data have been centrally collected and refer to specific provisions in national law.

World Population Policies Database

Description
Since the mid-1970s, the World Population Policies Database, last updated in 2015, provides comprehensive and up-to-date information on the population policy situation and trends for all Member States and non-member States of the United Nations. Among several areas, the database shows the evolution of government views and policies with respect to internal and international migration. The migration strand covers internal migration, immigration, emigration, and return. The Database is updated biennially by conducting a detailed country-by-country review of national plans and strategies, programme reports, legislative documents, official statements and various international, Inter-governmental and non-governmental sources, as well as by using official responses to the United Nations Inquiry among Governments on Population and Development.

UN Inquiry on population and development - International Migration

Description
The Inquiry gathers critically important data for monitoring the implementation of the Programme of Action of the International Conference on Population and Development and other international agreements, including the 2030 Agenda for Sustainable Development. The Inquiry, mandated by the General Assembly in its resolution 1838 (XVII) of 18 December 1962, has been conducted by the Secretary-General at regular intervals since 1963. The Twelfth Inquiry consists of multiple-choice questions, organized in three thematic modules: Module I on population ageing and urbanization; Module II on fertility, family planning and reproductive health; and Module III on international migration. In 1994, Member States attending the International Conference on Population and Development (ICPD) in Cairo agreed that “population-related goals and policies are integral parts of cultural, economic and social development” and recommended that actions be taken “to measure, assess, monitor and evaluate progress towards meeting the goals of its Programme of Action”. The year 2019 will mark the twenty-fifth anniversary of the Cairo conference and adoption of the ICPD Programme of Action, which continues to provide crucial guidance for addressing the fundamental development challenges facing the world today. Population issues are also at the core of the 2030 Agenda for Sustainable Development adopted in 2015. The United Nations Inquiry among Governments on Population and Development (the “Inquiry”) gathers critically important data for monitoring the implementation of the ICPD Programme of Action and other international agreements, including the 2030 Agenda for Sustainable Development. The Inquiry, mandated by the General Assembly in its resolution 1838 (XVII) of 18 December 1962, has been conducted by the Secretary-General at regular intervals since 1963. Description
The index is based on three types of entry visa restrictions: visa required, visa not required for short stays and visa not required. The author identifies country pairs which changed their visa regime during 1998–2010. This immigration policy index is constructed for all countries and territories in the world for both March 1998 and November 2009. This index is heterogeneous across destination and origin countries as well as over time.

Le projet MOBOUA a rassemblé 16 chercheurs dans quatre pays d'Afrique de l'Ouest, dont 9 relevant des universités partenaires Abdou Moumouni de Niamey, du Mali et de Ouagadougou. Rappelant que la sous-région "retient mieux ses migrants qu'elle ne les exporte", il s'est démarqué de commandes de recherche portant sur les remises financières des "migrants" au Nord ; et sur la montée en force de tendances xénophobes dans les espaces politiques africains. L'approche retenue est celle de la mobilité dans ses différentes échéances et amplitudes (internationales, nationales, locales) et leur articulation spatio-temporelle dans une perspective analytique. L'argumentaire s'illustre en particulier sur trois types de mesures scientifique : 1. Les circulations internationales intra-africaines 2. Les prolongements intra-urbains, résidentiels et plus quotidiens, des mouvements vers les villes 3. Les liens sociétaux que les migrants entretiennent avec d'autres composantes, migrantes et non migrantes, du peuplement africain. Pour ce faire, le projet s'est donné pour objectif d'argumenter de l'intérieur la dynamique et la diversité d'un "Sud, aujourd'hui" ; d'analyser circulations et relocalisations en associant deux méthodes dans un dispositif de recherche pluridisciplinaire : le suivi biographique et pluri-générationnel des migrants selon leurs parcours respectifs ; l'observation de sites significatifs de l'accès des ruraux et des citadins aux ressources économiques et sociales locales. L'investissement méthodologique est donc un point fort de MOBOUA. Sont conjugués une approche "macro" de la migration internationale (mise à jour critique de diverses sources internationales) et de nombreuses collectes de première main : approche anthropologique, suivi territorial de migrants devenus citadins, protocole statistique d'enquêtes quantitatives. Quatre bases de "micro" données individuelles sont notamment en cours de traitement. Les résultats scientifiques obtenus répondent aux attentes initiales du projet sur les axes d'échanges retenus dans ses trois ateliers : - A chaque génération ses migrants : la recomposition des mobilités internes et internationales se cale sur les cycles de vie des candidats au départ, mais aussi sur les conjonctures historiques et la transition démographique marquant la sous-région à rythmes différenciés dans les pays. - Le passage théorique et méthodologique de "migrants à citadins" comble un déficit de connaissances localisées. L'articulation en ville de différentes mobilités participe pleinement de leurs recompositions familiales et politiques. - Au-delà des catégories d'installation et de mouvement, expériences collectives et projets migratoires plus individués se confrontent en réactivant de vieilles méridiennes de circulation entre Sahel et Côte Atlantique. L'impact des crises ivoiriennes compte dans les perspectives envisagées par MOBOUA tant pour l'avenir des migrations internationales ouest-africaines, que pour la contribution des apports démographiques externes aux dynamiques de métropolisation.
