Irregular Immigrants and Control Policies in the UK

Illegal immigration, irregular migrants and the processes used by governments and other official bodies to deport, prosecute or otherwise undertake enforcement activities against people on the basis of immigration status form one of the most contentious and vexed element of global migration debate. This report presents findings from an ESRC-funded project examining irregular migration and immigration enforcement in the UK. The study focuses specifically on in-country immigration law enforcement and its effects, impacts and limits, a phenomenon that has so far received very little academic attention. It looks at the impact of increasingly tight legislation and robust enforcement measures on irregular migration and on irregular immigrants; in particular, it investigates: The organisational structure, culture and practices of immigration law enforcement agencies; The political, legal, practical and ethical limits of law enforcement; The interaction between irregular immigrants’ strategies, employer practices and enforcement measures; How irregular migrants navigate internal immigration controls; The impact of enforcement on irregular migrants’ access to fundamental rights; How this suite of processes, actions and impacts are perceived and shape policies. The investigation considers three sometimes overlapping groups – immigration enforcement (29 individuals interviewed)– which are examined at both a managerial and delivery level; stakeholder groups such as public service providers (16 individuals) and employers (18 individuals), who are also charged with the enforcement of migration laws, as well as voluntary sector organisations (21 individuals); and the target groups for enforcement action – notably the irregular migrants themselves (175 individuals).

Europe’s response to the so-called ‘migration crisis’ has been driven almost exclusively by a border control agenda. This has significantly reduced the number of refugees and migrants arriving in Greece, for the time being at least, but has done nothing to address the drivers or causes of migration to Europe, including the movement of people from Libya which continues unabated, or the protection and integration needs of those who are already here. The research aims to: • Shed light on the dynamics (determinants, drivers and infrastructures) underpinning the recent unprecedented levels of migration across, and loss of life in, the Mediterranean; • Provide insights into the interaction of refugees and migrants with a multitude of non-State actors (for example smugglers, facilitators, and Non- Governmental Organisations (NGOs) and State actors (for example, the navy / coastguard) in order to better understand their decision making processes; and • Explore how the decisions made by refugees and migrants on their journeys interact with dramatically changing global economic, security and political contexts.

Remittances flowing from Ukrainian migrants working in high-income countries to Ukraine are an increasingly important source of extra income for migrants’ families. Given the increasing size of aggregate remittance inflows, they are also expected to be a potential source of funding for the social and economic development of Ukraine as a whole. If remittances enhance investment in physical and human capital and thus boost productivity, they can help mitigate the possible negative economic effects of rapid population decline and the aging of the Ukrainian population. Yet the potential benefits of remittances are likely to be matched by potential costs. Thus, two main issues are of interest with regard to remittances in Ukraine: • what are their benefits and costs for migrants’ families, local communities, the Ukrainian economy and society; and • how to harness their development potential while limiting any counterproductive side effects. This paper directly addresses these two questions. It does so by reporting first results from an ongoing effort to assess the potential development and unwanted side effects of remittances in Ukraine. These results come from a survey of the empirical literature in Ukraine and other transition economies and are supported, where possible, by the author’s contributions. The purpose of this work is to draw out evidence-based policy implications.

Irregular migration was first noted during the 1970s, peaked around 2000 and is decreasing, the stock dropped to 3.8 million in 2008 and the flow of clandestine entry dropped to 103,000 apprehensions in 2009. Migration and border controls have been stepped up considerably by the EU and its member states over the past 15 years and were also extended to almost all neighbouring and transit countries along the main routes. Although clandestine entry, notably the arrival of boat people triggers most attention and is high on the policy agenda the overwhelming majority of irregular immigrants enter legally and then overstay, work in breach of their visa limits or otherwise lose their status; others claim asylum, are refused but stay on irregularly.
